the learned counsel for the parties. Page 1 of 5 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Barbil P.S. Case No.39 of 2025 corresponding to G.R. Case No.100 of 2025 pending in the file of learned JMFC Barbil, for commission of offences punishable U/Ss.142(2)/61(2)/3(5) of BNS, on the allegation of abducting and demanding ransom of Rs.2,00,000,00/- from the wife of one Nimananda Pradhan alongwith co- accused persons and eventually securing ransom amount of Rs.60,00,000/- from her for his release. 4.

Heard, Mr. Amulya Ratna Panda, learned counsel for the petitioner in BLAPL No.6075 2025; Mr. Sk. Zafarulla, learned counsel for the petitioner in BLAPL No.6090 of 2025; Mr. Debasnan Das, learned counsel for the petitioner in BLAPL No.6364 of 2025; Mr. Sidhartha Das, learned counsel for the petitioner in BLAPL No.6620 of 2025; Mr. Arijeet Mishra, learned counsel for the petitioner in BLAPL No.6643 of 2025 and Mr. A. Pradhan, learned Addl. PP in these matters and perused the record. 5. After having considered the rival submissions upon perusal of record, there appears direct allegation against the petitioners-Jamil Akhtar and Rajendra Paswan for abducting Nimananda Pradhan, but there appears allegation against the petitioners Sadab Naubahar and Farha Parbin for concealing the ransom money secured by co-accused, but there appears allegation against the petitioner-Goura Mohan Saha Page 2 of 5 Chowdhury @ Chandan for assisting in abducting the husband of the informant, but the abduction took place on 25.02.2025, however, the said petitioner has been in custody in connection with Joda P.S. Case No.279 dated 15.10.2024. Besides, there is no specific allegation against the petitioners-Sadab Naubahar, Goura Mohan Saha Chowdhury @ Chandan and Farha Parbin for abducting the husband of the informant. Besides, the petitioner Farha Parbin is a lady and right now after completion of investigation, charge sheet has already been submitted. 6. In view of the above facts and looking at the individual allegation against the petitioners and taking into consideration the rival submissions and other circumstance on record in entirety including the mandate of first proviso appended to Section 480 of BNS and keeping in view the custody of the petitioner- Goura Mohan Saha Chowdhury @ Chandan in another case at the time of occurrence, this Court without expressing any opinion on merits does not consider it proper to grant bail to petitioners-Jamil Akhtar and Rajendra Paswan, but at the same time considers it proper to grant bail to petitioners Sadab Naubahar, Goura Mohan Saha Chowdhury @ Chandan and Farha Parbin. 7. Hence, while rejecting the bail applications of the petitioners- Jamil Akhtar(BLAPL No.6090 of 2025) and Rajendra Paswan (BLAPL No.6364 of 2025), the bail applications of the petitioners -Sadab Naubahar (BLAPL Page 3 of 5 No.6075 of 2025), Goura Mohan Saha Chowdhury @ Chandan(BLAPL No.6620 of 2025) and Farha Parbin (BLAPL No.6643 of 2025) are hereby allowed and the petitioners Sadab Naubahar, Goura Mohan Saha Chowdhury @ Chandan and Farha Parbin be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following conditions:- (i) the petitioners Sadab Naubahar, Goura Mohan Saha Chowdhury @ Chandan and Farha Parbin shall not commit any offence while on bail, (ii) the petitioners- Sadab Naubahar, Goura Mohan Saha Chowdhury @ Chandan and Farha Parbin in the course of trial shall attend the trial Court on each date of posting without fail unless their attendance is dispensed with. In case the Petitioners fail without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioners for offence U/S.269 of BNS, 2023 in accordance with law and, (iii) the petitioners- Sadab Naubahar, Goura Mohan Saha Chowdhury @ Chandan shall report attendance before the Jurisdictional Police Station once in a fortnight preferably on Sunday of each month in between 10 A.M. to 12 Noon for six (06) months from the actual date of release from the custody. The I.I.C. of Jurisdictional Police Station shall not detain the petitioners-Sadab Naubahar and Goura Page 4 of 5 Mohan Saha Chowdhury @ Chandan unnecessarily after recording their attendance beyond the time as stipulated. It is clarified that the Court in seisin of the case will be at liberty to cancel the bail of the petitioners without further reference to this Court, if any of the above conditions are violated or a case for cancellation of bail is otherwise made out. In the wake of aforesaid, the subsequent involvement of the petitioners in future for similar/grave offences on prima facie accusations may be treated as a ground for cancellation of bail in this case. 8.
