Heard learned counsel for the Petitioner and the State.

This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s.379/34 IPC.

It is submitted by the learned counsel for the Petitioner that the Petitioner is the owner of the vehicle involved in the alleged crime but is not aware of the alleged crime.

Keeping in view the nature of allegation, the gravity and the seriousness, this Court while not inclined to grant anticipatory bail, it is directed that in the event the Petitioner surrenders in connection with Baghamari P.S. Case No.61 of 2024 corresponding to G.R. Case No.257 of 2024 pending in the court of learned J.M.F.C. (Cog.), Khurda within a period of three weeks’ hence and moves for bail, he shall be released on such terms and conditions as would // 2 // be deemed just and proper by the said court subject to deposit of cash of Rs.7,000/- (rupees seven thousand) in the manner to be directed by the learned court concerned with further condition that he shall produce valid registration of certificate of the vehicle.

The learned trial court, however, shall verify the antecedent of the Petitioner. In case of antecedent, this order shall not be given effect to.
