ORDER 30.04.2026 Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are seeking pre-arrest bail in connection with G.R. Case No. 304 of 2026 pending on the file of learned SDJM, Panposh, Rourkela, arising out of Plantsite P.S. Case No.93 of 2026 for commission of offences punishable under Sections 126(2)/ 296/ 115(2)/ 351(2)/ 3(5) of the BNS r/w Section 25 of the ARMS Act.

At the outset, it is submitted by the learned counsel that Petitioner No.2 has been taken to custody. As such, the ABLAPL qua the said Petitioner No.2 (Alok Nath @ Mukul) has been rendered infructuous. The ABLAPL is confined to Petitioner No.1.

Referring to the allegations in the FIR, it is submitted that considering the omnibus nature of allegations, Petitioner No.1 may be protected by pre- arrest bail.

Learned counsel for the State opposes the prayer for pre-arrest bail inter alia on ground of following criminal antecedents:-

i) Uditnagar PS Case No- 117/2018, U/s- 341/323/294/506/34 IPC. ii) Plantsite PS Case No- 141/2022, U/s- 341/323/34 IPC. iii) Plantsit PS Case No-336/2023, U/s- 341/323/354/506/34 IPC iv) Uditnagar PS Case No-39/2023, U/s- 341/323/34/294 IPC v) Plantsite PS Case No- 166/2020, U/s- 147/148/302/149/120-B IPC.

Taking into account the nature of allegations, this Court is not inclined to entertain the ABLAPL. However, it is directed that the Petitioner No.1 (Pappu Kumar Sahoo @ Papu Kumar Sahu) may surrender before learned SDJM, Panposh, Rourkela in connection with the aforementioned case within one month from today. In the event of his surrender and motion for bail, the same be considered by the learned SDJM, Panposh, Rourkela on merits, in the first hour of the day. In the event of rejection of the prayer for bail by the learned SDJM, Panposh, Rourkela, the Petitioner No.1 is at liberty to move the higher forum for bail in the second hour on the same day.

On being so moved, the higher forum is requested to make an endeavor to dispose of the bail application of the Petitioner No.1 on the same day. The case diary be made available to the concerned courts to facilitate disposal of the bail application of the Petitioner No.1 and learned SDJM, Panposh, Rourkela is called upon to transmit the case record to the higher forum at the earliest in the event of rejection of such bail application. Ground of parity, if any, may be considered by the learned court(s) below.
