Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Spl. G.R. Case No.102 of 2023, pending in the Court of the learned Additional District & Sessions Judge-cum-Special Court under POCSO Act, Angul, arising out of Colliery P.S. Case No.0056 of 2023 for alleged commission of offences under Sections 363/376(2)(n)/366/109/376(3)/366-A of IPC read with Sections 4(2)/6/17 of POCSO Act and Sections 3(2)(v)/3(2)(va)/3(1)(w)(i) of SC & ST (PoA) Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned A.D.J.-cum-Special Court, under POCSO Act, Angul, by order dated 21.03.2023 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the principal accused has since been released on bail by this Court by order dated

Taking note of the same and keeping in view the filing of the charge sheet and keeping in view the judgment of the apex Court in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & Another, reported in 2022 (10) SCC 51 relating to parity, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.
