Decision

ORDER 18.03.2025 01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Petitioners as well as learned Additional Standing Counsel for the State- Page 4 of 6. Opposite Parties. 3. The Petitioners have filed the present writ application with the following prayer: “It is, therefore, prayed that this Hon’ble Court may graciously be pleased to admit this writ application, call for the records, issue notice to the Opp.Parties and on hearing issue writ of mandamus directing the Opp.Parties to extend the ex-gratia compensation under the provisions of Orissa Resettlement and Rehabilitation of Projects Affected persons Policy, 1994, which ex-gratia compensation benefits already paid to the similar displaced people of Subarnarekha Irrigation Project within a stipulated time. And pass any other order/orders as would be deem fit and proper as facts and circumstances of the case.” 4. In course of hearing of the writ application, learned counsel for the Petitioners submits that the Petitioners, ventilating their grievance, have submitted representation before the Director (R&P) & Ex-Officio, Additional Secretary to Government, Department of Water Resources Department, Opposite Party No.2 under Annexure-5. It is also submitted by the learned counsel for the Petitioners that the said representation is still pending as of now. It is also submitted by the learned counsel for the Petitioners that a direction be issued to the Opposite Party No.2 to consider the representation of the Petitioners under Annexure-5 within a stipulated period of time. 5. Learned Additional Standing Counsel submits that he has no objection if the representation of the Petitioners is Page 5 of 6. considered by the Opposite Party No.2, which is stated to be pending, in accordance with law within a stipulated period of time. 6. Considering the limited nature of grievance of the Petitioners, the writ application is disposed of at the stage of admission with a direction to the Opposite Party No.2 to consider the representation of the Petitioners under Annexure-5 keeping in view the Rehabilitation and Resettlement applicable to the facts of the petitioner’s case as well as Annexures-2 and 4, within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.2 shall do well to dispose of the representation of the Petitioners under Annexure-5 by passing a speaking and reasoned order. The decision so taken by the Opposite Party No.2 be also communicated to the Petitioners within ten days thereafter. 7.
