Heard learned counsel for the Petitioner and the State.
By means of this application, the Petitioner seeks grant of bail U/s. 438 of CrPC in apprehension of arrest for his alleged involvement in the offences under Sections 294/323/34/498-A/506 of IPC, R/w. Section 4 of D.P. Act.
Learned counsel for the Petitioner submits that after valid service of notice to Opposite Party No.2- wife, she did not appear before this court today.
Keeping in view the allegations appearing in the FIR and other documents and the nature of allegations as emerged from the materials on record, the circumstances appearing, the seriousness and gravity of the offences while this Court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioner surrenders and moves for bail in connection with Dhenkanal PS Case // 2 // No.589 of 2023 corresponding to GR Case No.1073 of 2023 pending before the learned S.D.J.M, Kamakhyanagar within a period of three weeks hence, the Petitioner shall be released on bail on such terms and conditions as would be deemed just and proper by the said court subject to deposit of Rs.5,000/- (Rupees Five Thousand only) by the Petitioner the account of Informant and acknowledgement along with the application for bail to the satisfaction of the court concerned. The ABLAPL is disposed of accordingly.
