#1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Bhawanipatna Town PS Case No.292 of 2025 corresponding to CT Case No.763 of 2025 pending in the file of learned SDJM, Bhawanipatna, Kalahandi commission of offence punishable U/Ss.126(2)/ 115(2)/ 296/ 103(1)/3(5) of the BNS, on the main allegation of committing murder of the deceased Satyanarayan Ray, along with co-accused persons in furtherance of their common intention.
#2. Heard, Mr. Sisira Panigrahi, learned counsel for the petitioner and Mr. C. Mahanty, learned Additional Public Prosecutor in the matter and perused the record.

After having considered the rival submissions upon perusal of record, there appears allegation against the Petitioner for abusing and giving fist blow to the deceased and his friend, but the main allegation of stabbing the deceased is directed against co-accused Raja Bag. Further, the materials on record disclose that the incident occurred on a spur of moment without any premeditation or plan. In the aforesaid facts and circumstances and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the materials placed on record and taking into account the circumstance of transaction concerning the case and keeping in view the main allegation of stabbing the deceased being directed against co-accused Raja Bag and there being allegation against the other co-accused Roshan Lal Bag and Sibananda Gouda for holding the deceased, but these aforesaid three persons being not before this Court in this bail application and taking into account the role as alleged against the Petitioner and investigation having already been completed with submission of charge sheet, this Court without expressing any view on merits admits the petitioner to bail.

Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- (i) The petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless his attendance is dispensed with. In case the Petitioner fails without sufficient cause appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law.
#5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
