#1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

#2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Fategarh PS Case No.46 of 2023 corresponding to ST Case No.141 of 2023 pending in the file of Addl. District and Sessions Judge, Nayagarh for commission of offences punishable U/Ss. 323/ 325/ 326/ 307/ 302/ 147/148/149 of the IPC, on the main allegation of attacking and killing one Sarat Kumar Panda and injuring others by means of deadly weapons, along with co-accused persons.

#3. Heard, Mr. Sapan Kumar Lenka, learned counsel for the Petitioner and Mr. C. Mahanty, learned Addl. PP in the matter and perused the record together with the evidence of PW1 to PW12.

#4. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the materials placed on record together with the evidence of the witnesses so far examined, more particularly that of PW5,6 & 12 and keeping in view the another material eye witness Benga Pradhan as stated by the learned Addl. PP being yet to be examined and taking into account the other circumstances on record in entirety, this Court is not inclined to grant bail to the Petitioner.

#5. Hence, the bail application of the petitioner stands rejected. In view of the alternative oral prayer as advanced for the Petitioner, trial be expedited, if there is no other legal impediment.

#6. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the learned trial Court. (G. Satapathy) Priyajit Judge
