ORDER 16.03.2026 Heard learned counsel for the respective parties. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Badabazar P.S. Case No.136 of 2022 corresponding to G.R. Case No.1204 of 2022 pending in the file of learned S.D.J.M., Berhampur on the grounds stated therein.
Perused the FIR as at Annexure-1. A case under Section 307 IPC has been registered along with other allied offences. Learned counsel for the petitioner submits that the co-accused persons are on bail. It is informed to the Court by the learned counsel for the State that investigation is concluded with the filing of chargesheet in the meantime. The Court is further informed that other two of the accused persons have been granted bail by the learned court below. Considering the above facts and the submissions of learned counsels for the respective parties and since there is an attempt to assault, this Court, in view of the closure of the investigation with the filing of chargesheet, though not inclined to grant pre-arrest bail to the petitioner but is of the view that he should be directed to surrender before the learned court below for being released with suitable conditions.
Accordingly, it is ordered. In the result, ABLAPL is disposed of. It is further directed that in the event, the petitioner surrenders within a fortnight from today before the learned S.D.J.M., Berhampur in connection with Badabazar P.S. Case No.136 of 2022 corresponding to G.R. Case No.1204 of 2022, he shall be released on bail subject to him furnishing a bail bond of Rs.30,000/- (Rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case.
