It is agreed by learned counsel on both the sides that an order similar to the one dated 24th April, 2023 in W.A. No.366 of 2021 (State of Odisha v. Banamali Swain and others) and batch may be passed in respect of two batches of matters pertaining to College cases. 5. In other words, in all the writ appeals in these two batches, the corresponding orders under appeal in the writ petitions were passed by the learned Single Judge on the very first date of listing of the writ petitions. Although in some of the writ petitions counter affidavits may have been filed by the Appellant-State, those were not discussed in the impugned orders of the learned Single Judge. In many others, no counter affidavits had even been filed. Page 63 of 68 6. In line with the order passed by this Court on 24th April, 2023 in the aforementioned matter Banamali Swain (supra), this Court while setting aside the impugned orders of the learned single Judge remands the corresponding writ petitions in these two batches of writ appeals to the file of the learned Single Judge in the roster Bench. Since this is likely to be a large batch, the Court directs that the Direct Payment matters be listed before the learned Single Judge on 18th September, 2023. Wherever a counter has not been filed, it will be filed in the concerned writ petitions on or before 4th September, 2023 and the rejoinder, if any, thereto shall be filed on or before 18th September, 2023. It is made clear that no further time will be granted for the above purposes to any of the parties. As far as the School matters are concerned, while setting aside the impugned orders of the learned Single Judge in the corresponding writ petitions in this batch of writ appeals, the Court directs that the said writ petitions along with W.P.(C) No.19636 of 2019 be listed before the learned Single Judge on 16th October, 2023. The replies by the State if required to be filed, shall be filed not later than 3rd October, 2023 and the rejoinder thereto, if any, shall be filed on or before 16th October, 2023.
