This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

The Petitioner has filed the present writ application with the following prayer:

Under the above circumstances it is, therefore humbly prayed that this Hon’ble Court may graciously be pleased to issue a writ in appropriate nature directing respondents more particularly the respondent no- 2 to consider & dispose of the representation under Annexure- 10 by extending the benefits in terms of the decision of the Hon’ble High court reported in 2003 (II) O.L.R.321 & at par with other similarly placed Contractual PETs as per the Orders passed under Annexure 3 series and 7 & 8 Series and issue necessary direction to the Respondent Page 1 of 3. No- 2 to fix the pay appropriately at grade pay of Rs. 2800/- and the corresponding Pay at Cell- 01 Level- 8 under ORSP Rules 2017 w.e.f. 17.09.2022, sanction & disburse all consequential benefits in the I.A. C. P.Ed, scale with effect from 17.09.2022 forthwith or within a time to be stipulated by this Hon’ble Court

Counsel for the Petitioner draws attention of the Court to the representation dated 13.08.2024, a copy whereof avails at Annexure10. He further adds identical matters representations are favourably considered, whereas a discriminatory attitude has been shown to his client, which is in violation of Article 14 of the Constitution of India. He also quotes E.P. Royappa v. State of Tamil Nadu, AIR 1974 SC 555, in support of his contention.

Learned Additional Standing Counsel appearing for the OPs opposing the petition very fairly says that he would instruct his clients to look into the grievance of the Petitioner, as has been aired in the subject representation keeping in view alleged similar orders at Annexure-8 series. He caveats the Court that all contentions of the parties should be kept open and a reasonable time period be prescribed for accomplishing the task. With this proposal, counsel for the Petitioner is fairly agreeable.

In view of the aforesaid submissions made by learned counsels appearing from both sides, further taking consideration the limited nature of the grievance involved in the present writ application and the fact that similar benefits have already been extended in favour of similarly situated persons, further taking into consideration the fact that the Petitioner has already approached the Opposite Party Nos.2 & 3 by filing Page 2 of 3. representation under Annexure-7 series, this Court deems it proper to dispose of the present writ application by directing the Opposite Party Nos.2 & 3 to consider the grievance of the Petitioner as involved in his representation keeping in view the aforesaid observations and in the event such representation has not been disposed of the meantime. It is further directed representation of the Petitioner shall be considered strictly in accordance with law and shall be disposed of by passing a speaking and reasoned order within eight weeks from the date of communication of a certified copy of today’s order. The final decision so taken be communicated to the petitioner within ten days’ thereafter. The Opposite Party Nos.2 & 3 shall do well to take into consideration all the documents likely to be filed by the Petitioner including the documents at Annexures-6 and 8 along with a certified copy of today’s order.

It is open to the answering Opposite Parties to solicit any information or documents from the side of the Petitioner, as required for taking a decision on the subject representation. However, in that guise delay shall not be brooked.
