This application under Section 397, read with Section 401 of Cr.P.C. has been filed challenging the order dated 09.10.2023 passed by the learned Additional Sessions Judge, Angul in C.T. Case No. 51 of 2021 arising out of G.R. Case No. 2072 of 2020 which corresponds to Angul P.S. Case No.1235 of 2020, rejecting his application for discharge from the offences under Sections 376(2)(n),417,493,494,506 of the IPC.
Mr. K. Mohanty, learned counsel for the petitioner files a memo stating that the dispute has been settled between the parties, for which the petitioner does not want to prosecute the present revision. He has prayed for liberty to withdraw the revision to file appropriate application and change in scenario if the situation so demands. The said memo is taken on record.
Liberty prayed for is not granted. It goes without saying that in case of any fresh cause of action, the petition can file appropriate application.
