#2. The instant petition is preferred under Section 482 of Cr.P.C. against the order dated 30.01.2018 passed by First Additional Sessions Judge, Chanderi whereby the order passed on 11.03.2017 by J.M.F.C. Ashoknagar in Crime Case No.29/2013 has been confirmed.
#3. At the outset, learned counsel for the parties on the basis of instructions received submit that both the parties have entered into the 2 compromise whereby they have filed an application under Section 13-B of Hindu Marriage Act, 1955 before the concerned ADJ Court Chanderi. Petitioner has paid Rs.4,00,000/- through demand draft as part of permanent alimony and Rs.3,50,000/- is to be paid at final stage. Therefore, both the parties did not intend to continue with the proceedings and want to withdraw this case.
#4. This Court specifically asked from petitioner and respondent about the facts narrated so. Both intend to settle the matter and want to withdraw this petition.
