THE STATE OF MADHYA PRADESH PRINCIPAL SECRETARY URBAN ADMINISTRATION AND DEVELOPMENT VALLABH BHAWAN BHOPAL (MADHYA PRADESH) THE CHIEF MUNICIPAL OFFICER MUNICIPAL COUNCIL (MADHYA PRADESH) BARWANI BARWANI THE PENSION OFFICER MUNICIPAL COUNCIL BARWANI BARWANI (MADHYA PRADESH) (BY SHRI A. S. PARIHAR, P.L./G.A.) .....RESPONDENTS This petition coming on for admission this day, th e court passed the following: ORDER This petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "It is therefore most respectfully prayed before this Hon'ble Court that this petition be kindly allowed and an appropriate writ may kindly be issued directing the respondent to pay the Signature Not Verified Signed by: BAHAR CHAWLA Signing time: 25-09-2023 18:05:04 2 retirement dues to the petitioner including interest at the rate of 12% per annum for the delay caused in making the payment of retiral dues. Any other relief which this Hon'ble Court deems fit in the facts and circumstance of the case may kindly be passed in the interest of justice. "
The grievance of the petitioner is that he stood superannuated on
31.12.2021 from the post of Heavy Vehicle Driver and till date his retiral dues have not been cleared by the respondent No.2. A representation in this behalf has already been filed by the petitioner, but the same has still not been decided. 3 . Counsel for the State, on the other hand, has submitted that the representation of the petitioner shall be decided expeditiously.
In view of the same, this Court is inclined to dispose of this petition with a direction to the petitioner to file a fresh representation along with all relevant documents before the competent authority/respondent No.2 within a period of two weeks from today and if such a representation is filed by the petitioner, the same shall be decided by the competent authority/respondent No.2 by a speaking and reasoned order, in accordance with law within a further period of four weeks and if it is found that the petitioner is entitled to the aforesaid benefits, the same may be extended to him within a further period of two months.
It is made clear that this Court has not reflected upon the merits of the case.
