This petition coming on for admission this day, JUSTICE SUSHRUT .....RESPONDENTS ARVIND DHARMADHIKARI passed the following: ORDER Signature Not Verified Signed by: SEHAR HASEEN Signing time: 2/22/2023 5:56:59 PM 2 In this petition under Article 226 of the Constitution of India, the petitioner has assailed the order dated 01.12.2022(P-6) and 20.12.2022 (P-7) by which, the formal affiliation order could not be passed, but the same was to be passed subject to inspection etc. by the respondent authorities.

Operative part

During the pendency of the writ petition, the respondent no. 1 and 2 have taken a decision to grant affiliation to the petitioner college on 14.02.2023 in the meeting of the Executive Committee of the University and has granted affiliation to the petitioner college. Learned counsel for the respondent no.1 and 2 submitted that in view of the aforesaid decision, formal affiliation order shall be issued to the petitioner college soon and the students for the academic session 2020-21 shall be enrolled and permitted to appear in the ensuing examination scheduled to commence from 27.02.2023. In view of the aforesaid, this petition is dismissed as having rendered infructuous. Also heard on I.A. No. 746/2023, an application for withdrawal of the affidavit dated 19.01.2023. Learned counsel for the respondent no.1 and 2 submitted that a wrong affidavit was filed in this case treating this matter as identical with other cases alongwith minutes of the meeting which were draft minutes of the meeting whereas in the present case, the Executive Committee decided to put on hold the grant of affiliation of the petitioner college subject to the report of the inspecting team.

In view of the aforesaid, the respondents may be permitted to withdraw the affidavit. Accordingly, I.A. is allowed. The respondents are permitted to withdraw the affidavit.
