This is 3rd application for grant of bail by applicant Bhagwan Singh Son of Shankar lal, who is implicated in crime no.28/2011, registered at police station – Pipal Ranwa Distt Dewas for the offence punishable under Section 147, 148, 294, 323, 506 and 302/149 of IPC. First and second bail applications were dismissed as withdrawn vide order dated 2.6.2011 & 20.9.2011 passed in M.Cr.C. Nos.4239/2011 and 6033/2011. Learned counsel for the applicant submits that all other co- accused persons have already been released on bail. He also drew my attention to the FIR lodged by Hukum Singh in cross case and statement of PW6 and submits that the allegation regarding causing injury to Laad Singh not attributed to the present applicant. He also submits that applicant was not aggressor. With the aforesaid he prays that this application for grant of bail be allowed and applicant be released on bail. On the other hand learned PL opposed the prayer and prays for its rejection. As per statement of prosecution witnesses the main allegation regarding causing injury to the deceased – Laad Singh is against the present applicant, it is he who caused fatal injury to the deceased. The statements of doctor and I.O. is yet to examine. There is no change circumstances after rejection of first and second bail applications. At this stage, no case for grant of bail as prayed by the applicant is made out. ss/- (P.K. JAISWAL, J.)
