This is a repeat application u/s. 439 of Cr.P.C. for grant of bail to the applicants. The earlier application of applicants was rejected by this Court by order dated 2.12.2011 passed in M.Cr.C. Nos.9280/2011 and 9281/2011. A criminal case (Crime No.758/2011) has been registered at Police Station Tukoganj, Indore for offences punishable u/s. 3, 4, 5 and 7 of the Immoral Traffic Prevention Act, 1956 against 13 persons. Applicants herein were arrested by the Police on 21.11.2011 and after investigation, charge-sheet has been filed. It is not disputed that similarly placed other accused persons have already been granted bail by this Court subsequently, in M.Cr.C. 2 Nos. 9375/2011, 9386/2011, and 9307/2011. Three of the accused persons viz. Deepak, Sonu and Baljeet have already been granted bail by the trial Court. Certified copies of the orders passed by the trial Court have been placed on record. In view of the aforesaid, we allow the application and direct that the applicants be released on bail subject to their furnishing personal bonds in the sum of Rs.50,000/- [Rs. Fifty Thousand] each with separate sureties in the like amount to the satisfaction of the trial court for their appearance before the said Court on all such dates as may be fixed in this behalf during trial.
