This petition coming on for hearing this day, th e court passed the .....RESPONDENTS SANSignature Not SANSignature Not Verified Verified following: RASHMI RONALD RASHMI RONALD VICTOR VICTOR 11:37:44 IST 11:37:44 IST ORDER 2 Learned counsel for the petitioner submits that after passing of the final award on 09/07/2019 in claim case, the petitioner and the claimants filed joint application for compromise under Section 151 of CPC supported by their respective affidavits but without recording compromise, learned Court below has dismissed the application vide impugned order dated 23/10/2019. Learned counsel for the petitioner submits that instead of rejecting the application, the learned Court below ought to have recorded the compromise as has been held by this Court in the case of Durjan Singh Vs. State of M.P. reported in 1994 (II) MPWN 2. In view of aforesaid, it is directed that the learned Court below shall record the compromise first and only thereafter shall pass the orders on the application in accordance with the aforesaid pronouncement of this Court.
