Operative part

18.3.2009 passed by 5th Additional District Judge (Fast Tract Court), Rewa in Civil Suit No.-4-A/2008 by which the suit filed by the plaintiff/ respondent was decreed. The parties have now moved an application under Order 23 Rule 3 of CPC stating that they have already entered into compromise. On receipt of the application, the matter was sent to Registrar J-I for verification of compromise. Report has now been received from Registrar J-I stating that the compromise is in order and the parties have entered into the same without any fear or pressure. Therefore, in view of the compromise arrived at between the parties and the report of Registrar J-I the application under Order 23 Rule 3 is allowed. The present appeal is disposed of in terms of compromise entered into by the parties. Decree be drawn up accordingly. The terms of the compromise filed along with the application under Order 23 Rule 3 of CPC shall be treated to be integral part of the decree. Court fees deposited by the appellant shall be refunded.
