09.08.2022 Sanjay Kumar (C.J.): [1] The Central Bureau of Investigation (CBI) filed these four petitions under Section 482 Cr.P.C. praying for clubbing of certain FIRS and to direct the jurisdictional Courts to send the case records and exhibits pertaining thereto to the Court of the learned Chief Judicial Magistrate, Imphal West. [2] Heard Mr. W. Darakishwor, learned counsel, appearing for the Central Bureau of Investigation (CBI); Mr. RK. Umakanta, learned PP, appearing for the State authorities in Cril. Petn. No. 60 of 2019; Mr. Athouba Khaidem, learned PP, appearing for the State authorities in Cril. Petn. No. 33 of 2021, Cril. Petn. No. 40 of 2021 and Cril. Petn. No. 67 of 2021; Mr. BR Sharma, learned CGC, appearing for respondent No. 4 in Cril Petn. No. 60 of 2019 and respondent No. 2 in Cril Petn. No. 33 of 2021, Cril. Petn. No. 40 of 2021 & Cril. Petn. No. 60 of 2019 was filed for clubbing of four FIRs, viz., RC-07(S)/2018/SC-III/ND of CBI/SIT (Imphal West District); FIR No. 42(5)04 of Sekmai Police Station (Imphal West District); FIR No. 61(6)2004 of Lamlai Police Station (Imphal East District); and FIR RC-DST/2018/S/0024 of CBI/SIT and to direct the Courts concerned to send all the case records and exhibits to the Court of the learned Chief Judicial Magistrate, Imphal West, where Final Report/Charge Sheet was to be filed by the CBI/SIT in connection with RC-DST/2018/S/0024 of CBI/SIT. No. 130(11)2009 Yairipok PS (Thoubal District); FIR No.
121(10)2009 Heingang PS (Imphal East District); and FIR No. 37(10)2009 Gamnom Saparmeina PS (Senapati District), and to direct the Courts concerned to send all the case records and exhibits to the Court of the learned Judicial Magistrate First Class, Imphal East, Manipur, where Final Report has been filed by the CBI/SIT in connection with RC-DST/2018/S/0006 of CBI/SIT. [5] Cril Petn. No. 40 of 2021 was filed praying for clubbing of four FIRs, viz., RC-DST/2018/S/0028 of CBI/SIT; RC-12(S)/2018/SC-III/CBI/ND of CBI/SIT; FIR No. 40(3)/2004 of LLI PS; and FIR No. 66(3)04 of Imphal PS and to direct the Courts concerned to send all case records and exhibits to the Court of the learned Chief Judicial Magistrate, Imphal West, Manipur, where a Final Report has already been filed by the CBI/SIT in connection with RC-DST/2018/S/0028 of CBI/SIT [6] Cril. [7] Mr. RK Umakanta and Mr. Athouba Khaidem, learned PP, would inform this Court that all the FIRs have been transferred to the CBI along with relevant records and nothing more remains to be done in so far as the State police are concerned. Mr. W. Darakishwor, learned Sr. PCCG, would state that all Cril. Petn. No. 60 of 2019; & Ors. the case records have been transferred to the Court of the Chief Judicial Magistrate, Imphal West, which is seized of all the cases, and it is only the jurisdictional Court in Imphal East which is yet to make over the case records and exhibits in relation to FIR No. 61(6)2004 dated 01.06.2004 of Lamlai P.S. [8] In that view of the matter, these criminal petitions are disposed of directing the jurisdictional Courts in Imphal East to make over the case records and exhibits pertaining to the aforestated FIRs, if they are still in their custody, to the Court of the learned Chief Judicial Magistrate, Imphal West, as sought by the Central Bureau of Investigation.
