B E F O R E HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH 03-11-2023 Heard Mr. N. Kumarjit, learned senior counsel assisted by Mr. Monish Anand, learned counsel appearing for the petitioner and Mr. A. Vashum, learned GA appearing for the respondents No. 1 and 2. In view of the limited prayer made by the learned senior counsel appearing for the petitioner and as agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the Motion stage itself. At the outset, the learned senior counsel appearing for the petitioner submitted that the petitioner submitted a representation dated 11-10-2023 to the Registrar of Societies, Manipur raising his grievance and requesting for making an enquiry as contemplated under Section 22 of the Manipur Societies Registration Act, 1989, however, no action has been taken up by the Registrar of Societies, Manipur till today. The learned senior counsel submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by directing the Registrar of Societies, Manipur to consider the said representation on its own merit and strictly in terms of the applicable law and to dispose of the same by issuing a speaking order within a stipulated period.

Mr. A. Vashum, learned GA appearing for the respondents No. 1 and 2 fairly submitted that as the prayer of the petitioner is limited to the consideration and disposal of the representation submitted by him, he has no objection in disposing of the present writ petition as prayed for by the learned senior counsel appearing for the petitioner. -2- Taking into consideration the submission advanced by the learned counsel appearing for the parties and on careful perusal of the record, this court is of the considered view that it will serve the interest of justice to dispose of the representation by issuing the following directions:- (i) The Registrar of Societies, Manipur is directed to consider the representation dated 11-10-2023 submitted by the petitioner on its own merit and strictly in terms of the applicable provisions of acts and rules and to take up appropriate action as deem fit and proper; (ii) The Registrar of Societies is further directed that at the time of consideration of the said representation, reasonable opportunity should be given to both the petitioner and the private respondent No.

3, namely The Padma Ratna English School, a Society registered under the Societies Registration Act, 1960 represented by its President to have their say in the matter; and (iii) The whole process should be completed within a period of three months from the date of receipt of a certified copy of this order. With the aforesaid directions, the present writ petition is disposed of.
