noted prima facie. The holes stated in the Complaint were found only during when the outer peeling of the teak wood was conducted.

It is submitted the Assistant Devaswom Commissioner vide letter dated 27.09.2023 had intimated the Devaswom Commissioner to grant necessary permission for sealing coupon for an amount of Rs.19,26,000/- as preliminary expenses for conducting Devaprasnam, pariharakriya and for performing pooja of DBP No.80 of 2024 7 teak wood tree which is required for flag mast. A true copy of the letter dated 27.09.2023 issued by the Assistant Devaswom Commissioner, Thiruvalla, to the Devaswom Commissioner, along with the estimate and letter of the Tanthri, is produced herewith and marked as Annexure R1(a).

5. The Temple Advisory Committee of the said temple had submitted a detailed estimate conducting Dwajaprathistta and pariharakriya. The estimate forwarded the Devaswom Commissioner by Assistant Devaswom Commissioner, Thiruvalla, along with the application of TAC and letter of Thantri. On perusal of the estimate and report, Devaswom Commissioner had recommended to the Board for an approval for sealing the coupon for an amount of Rs.19,26,000/-. The Board has given the sanction to the same in tune with the recommendation. A true copy of the communication to the Devaswom Commissioner by the Board dated 10.10.2023 is produced herewith and marked as Annexure R1(b). Subsequently, the Assistant Commissioner, Thiruvalla, had forwarded a letter to the Devaswom Commissioner along with the letter of Thantri for sanction to dip the flag mast in the Ennathoni (oil tank).

6. In the meanwhile, news was spread through social media regarding the defects noted in the teak pole. The Assistant Engineer examined the teak pole in detail and furnished a report in this regard. On the examination, some cracks were noted but he had opined that such defects are not serious enough to affect the strength or life DBP No.80 of 2024 8 of the pole. He also suggested obtaining opinions from the Thanthri and Vasthu experts in this regard. A true copy of the report dated 04.05.2024 submitted by the Assistant Engineer, Thiruvalla, to the Devaswom Commissioner, Thiruvalla, is produced herewith and marked as Annexure R1(c). Thanthri has also given his opinion in this matter on

07.05.2024. A true copy of the opinion dated 07.05.2024 given by the Tanthri the Assistant Devaswom Commissioner, Thiruvalla, is produced herewith and marked as Annexure R1(d).

7. It may be noted that Opinions from three Devaswom vasthu experts named Mr.Manoj S. Nair, V.P. Chithtrabhanu and Elavalli K.K. Dasan Achari were obtained regarding the aforesaid matter. Mr.Manoj S. Nair suggested an Ottarasi Prasnam in this matter. Mr.K.K. Dasan Achari suggested strengthening of the pole by fixing a brass plate. A true copy of the Report dated 15.05.2024 of the Devaswom Commissioner to the Board in this regard is produced herewith and marked as Annexure R1(e). The Board had examined the matter in detail and had decided to conduct Ottarasi Pranam, vide order dated 17.05.2024. A true copy of the Board Order ROC No.11258/21/M dated 17.05.2024 is produced herewith and marked as Annexure R1(f).

8. It is submitted that Ottarasi Prasanam was conducted by a learned astrologer Mr. Budhanoor Vinod Kumar. It is seen that the will of God is favorable in the said Ottarasi Prasnam and that the deity is not displeased to use the same wood for Dwaja. In the said situation, the opinion of Devaswom Tantri was sought for depositing the teak wood DBP No.80 of 2024 9 in the oil tank for the initial stage of Dhwaja construction, and it was informed that the time to carry out the activities for the completion of the festival in the temple is on 5™ and 6% day of June 2024. Thanthri also informed that the date that can be performed for depositing the wood required for the construction of Dhwaja in the oil tank as 7th day of June 2024 at an auspicious time between 09:30 AM and 10:30 AM. 28.05.2024 of the Assistant Devaswom Commissioner, Thiruvalla to the Devaswom Commissioner is produced herewith and marked as Annexure R1(g). Pursuant to Annexure R1(g), the Devaswom Commissioner granted permission to the Assistant Devaswom Commissioner, Thiruvalla, for Thailadhivaasam of the teak pole. A true copy of the order ROC No.20621/23/PR dated 30.05.2024 issued by the Devaswom Commissioner to the Assistant Devaswom Commissioner, Thiruvalla, is produced herewith and marked as Annexure R1(h). As per the aforesaid opinions, it is clear that there are no serious defects in the teak pole, which makes it unsuitable for the said propose. It is only trivial in nature.”

Today, when this DBP came up for consideration, along with connected matters, i.e., W.P.(C)No.25713 of 2023 and DBP No.95 of 2023, we heard arguments of the learned counsel for the complainant, the learned Standing Counsel for Travancore Devaswom Board for respondents 1 and 2, the learned Senior Government Pleader for additional respondents 3 and 4 and also DBP No.80 of 2024 10 the learned Amicus Curiae for the learned Ombudsman.

Travancore-Cochin Hindu Religious Institutions Act, 1950 enacted by the State Legislature makes provision for the administration, supervision and control of incorporated and unincorporated Devaswoms and of other Hindu Religious Endowments and Funds. As per the provisions under Section 3 of the Act, the administration of incorporated and unincorporated Devaswoms shall vest in the Travancore Devaswom Board. As per Section 15A of the Act, it shall be the duty of the Board to perform the following functions, namely, (i) to see that the regular traditional rites and ceremonies according to the practice prevalent in the religious institutions are performed promptly; (ii) to monitor whether the administrative officials and employees and also the employees connected with religious rites are functioning properly; (iii) to ensure proper maintenance and upliftment of the Hindu religious institutions; (iv) to establish and maintain proper facilities in the temples for the devotees. As per Section 31 of the Act, subject to the provisions of Part I and the rules made thereunder, the Board shall manage the properties and affairs of the Devaswoms, both incorporated, and DBP No.80 of 2024 11 unincorporated as heretofore, and arrange for the conduct of the daily worship and ceremonies and of the festivals in every temple according to its usage.

As per Section 24 of the Act, which deals with the maintenance of Devaswoms, etc., out of the Devaswom Fund, the Board shall, out of the Devaswom Fund constituted under S.25, maintain the Devaswoms mentioned in Schedule I [i.e. incorporated Devaswoms], keep in a state of good repair the temples, buildings, and other appurtenances thereto, administer the said Devaswoms in accordance with recognised usages, make contributions to other Devaswoms in or outside the State and meet the expenditure the customary religious ceremonies and may provide for the educational upliftment, social and cultural advancement and economic betterment of the Hindu community. As per Section 31 of the Act, which deals with the management of Devaswoms, subject to the provisions of Part I and the rules made thereunder, the Board shall manage the properties and affairs of the Devaswoms, both incorporated and unincorporated as heretofore, and arrange for the conduct of the daily worship and ceremonies and of the festivals in every DBP No.80 of 2024 12 temple according to its usage.

10. The provisions under the Travancore-Cochin Hindu Religious Institutions Act referred to hereinbefore would make it explicitly clear that the role assigned to the Travancore Devaswom Board in the administration, supervision and control of incorporated and unincorporated Devaswoms is that of a trustee in the management of the properties vested in the deity. The Board is bound to administer, supervise and control incorporated and unincorporated Devaswoms in accordance with the provisions under the said Act. The Board and its officials are duty-bound to function within the framework of the statute by scrupulously following the stipulations contained therein and acting strictly in accordance with the settled legal principles relating to the administration of Hindu religious trust. The Board, being a trustee in the management of Devaswom properties, is legally bound to perform its duties with utmost care and caution.

11. The photographs of the teak pole, which form part of Annexure O1 complaint dated 04.05.2024 made by the complainant, are extracted hereunder; DBP No.80 of 2024 13

12. As evident from the photographs of the teak pole, which forms part of Annexure O1 complaint, there are cracks on the teak pole intended to be used as Dwaja Sthamba. The said fact is also evident from the inspection report dated 07.05.2024 of Dr. Manoj S. Nair, the Sthapathi of Travancore Devaswom Board, submitted before the Assistant Devaswom Commissioner, Thiruvalla. The said report reads thus; “മുകളിൽ വിഷയ സൂചികയിൽ പറ്ഞി്ടു്ള ക്തിൽ നിർദേശി്ച പ്പകാരം

05.05.24 രാവിലെ 10 മണിദയാടുകൂടി നിർേി്ി ലകാടിമരം DBP No.80 of 2024 14 പരിദശാധി്കുകയു്ിായി. ലകാടിമര്തിന്ലറ സമചതുര കട ഭാഗ്തു നിന്ും 150 cm ഉയര്തിൽ മുതൽ 220 cms വലര ഏതാ്ി് 70 ഓളം േീർഘ്തിൽ ഏതാ്ി് ര്ിു മുതൽ മൂന്ു ഇ്ഞ് ആഴ്തിൽ ഉ്ള ദപാടു ഉ്ളതായി കാണലെടുന്ു്ി്. കൂടാലത കടഭാഗ്തു നിന്ും 380 cms കഴി്ഞു 520 cm വലരയു്ള ഭാഗ്തു ഏതാ്ി് 40cm േീർഘ്തിൽ പ്പതയ്ഷ്തിൽ ര്ിിദ്ഞാളം ആഴമു്ള ലപാ്ടൽ കാണുവാൻ ഉ്ി് കടഭാഗ്തു നിന്ും 690 cm കഴി്ഞു 780cm വലര നീള്തിൽ മലറാരു ലപാ്ടെും കാണുവാൻ കഴി്ഞു. ഇത് കൂടാലത രദ്ിാ മൂദന്ാ ക്മുലക്ടും പ്ശ്ധയിൽ ലപ്ടു. അപ്ഗ ഭാഗ്തു അല്പം ലവ്ള ലതളി്ഞും കാണുന്ു്ി്. ദമല്പറ്ഞ ലപാ്ടെുകള് സാദേതികമായി ചു്ടു ലക്ടി എടു്തു ലകാടിമര്തിന്ലറ ബെല്ത ബാധി്കാലത എടു്കുവാൻ കഴിയുലമേിെും ശാസ്ദപ്താ്വമായ ഇ്തരം അപാകതകൾ വരുവാൻ പാടു്ളതെല. “അപദപ്കാഡാപ്വണം സിᨽ᪚്ധം പ്ഗ്ഭി രപ്ര വിവർ്ജിതം ദഭേ ദചേ വിവർജം ച ധവജ േ്ണതരൂർ ഭദവത്” (ശിെര്തനം) അക്തു ലപാദ്താ ദകദടാ ഇെലാ്തതും എ്ണമയമു്ളതും, കദ്മാ തുളകദളാ ഇെലാ്തതും വി്ളദൊ ലപാ്ടദൊ ഇെലാ്തതുമായ മരമാണ് ലകാടിതൂണിനു ഉപദയാഗിദ്ക്ിത് എന്് അടി്ഽാന പ്പമാണം പറയുന്ു. ്ഽപതി എന് നിെയിൽ ഈ പ്പമാണം അനുസരി്ചു മാപ്തദമ ദകാടിമര്തിലന വിെയിരു്തുവാൻ കഴിയും. ആ നിെ്ക് ഇദൊൾ ലകാടിമര്തിനായി ത്യാർ ലചയ്തിരി്കുന് തടി അപ്തക്ി് ദപ്ശഷ്ഠം അെല എന്് പറദയ്ിി വരുന്ു. ധാരാളം മനുഷയ പ്പയത്നവും ധനവയയവും നട്തി്കഴി്ഞ ഇ്തരം അവസര്ങളിൽ, തടി്കു കാരയമായ ബെ്ഷയം ദതാന്ി്കാ്തതിനാെും ഒരു അവസാന തീർലെന്നിെയിൽ സവാതികനായ ദേവ്ഞന്ലറ ഒരു രാശി പ്പശ്ന്തിെു്ള ദേവഹിതം അറിയുവാൻ ദനാ്കുന്ത് അഭികാമയമായിരി്കും എന്് ദതാന്ുന്ു. മുൻപ് ഉ്ിായിരുന് ലകാടിമര്തിന്ലറ ്ഽാനവും ഉയരവും ശരിയായിരുദന്ാ എന്് പരിദശാധി്ചു മാപ്തദമ പുതിയ ലകാടിമര്തിനു ആ അളവ് സവീകരി്കാവൂ. ഏലതേിെും തര്തിൽ ഉ്ള നയുനതകൾ അതിൽ ഉല്ിേിൽ അത് പരിഹരി്ചു്ള അളവിൽ മാപ്തദമ പുതിയത് ്ഽാപി്കുവാൻ പാടു്ളൂ. കാരയമായ ലപാ്ടെുകൾ കാണുന്തിനാൽ ദേവന്ലറ ഹിതല്ത ആപ്ശയി്ചു മാപ്തദമ അവസാന തിരുമാനം എടു്കാവു എന്ാണു ഇതിൽ എന്ലറ അഭിപ്പായം.” (underline supplied)

13. As evident from the report dated 07.05.2025 of Dr. Manoj S. Nair, the Sthapathi of Travancore Devaswom Board, there are holes in the teak pole intended to be used as Dwaja Sthamba, having a depth of 2 to 3 inches, which starts at 150 DBP No.80 of 2024 15 cms from the bottom of that teak pole, up to 220 cms. In addition to that, a crack having depth of 2 inches is seen on the teak pole, which starts at 380 cms from the bottom of the pole up to 520 cms, having a length of 140 cms. There is another crack, which starts at 690 cms from the bottom of the pole up to 780 cms. In the report dated 07.05.2024, it is stated that although the cracks seen in the teak pole can be mended without affecting the strength of the pole, as per the Sasthra, the pole intended to be used as Dwaja Sthamba should not have such defects. As per the Sasthra, the log without any decay or damage or holes or cracks should be used for the flag mast. On an evaluation of the teak pole intended to be used as Dwaja Sthamba in accordance with the Sasthra, the Sthapathi in the report dated 07.05.2024 stated that the said teak pole cannot be said to be one having superior quality. Since a lot of manpower and money has already been spent and the teak pole, on appearance, does not have any issues on its strength, for taking a final decision, it is appropriate to ascertain ‘Daivahitham’ by conducting ‘Ottarasi Prasnam’.

14. The Assistant Devaswom Commissioner, Thiruvalla, DBP No.80 of 2024 16 obtained a report dated 08.05.2024 from K.K. Dasan Achary, another Sthapathi of Travancore Devaswom Board. The said report dated 08.05.2024 reads thus; “തിരുവെല പ്ശീവെലഭ ദ്ഷപ്ത്തിൽ ധവജ നിർ്മാണ്തിന് ഉ്ള ലച്തിലവ്ച ലകാടിമരം 2024 ലമയ് ഏഴാം തീയതി ദ്ഷപ്ത്തിൽ വന്് പരിദശാധി്കുകയു്ിായി. ലകാടിമര്തിന്ലറ ര്ിു ഭാഗ്ങളിൽ ഒെിവ് ദകടു കാണുകയു്ിായി. ഇത് അപ്ത നി്ᩰാരമായി കാണാൻ കഴിയിെല. ആയതിനാൽ മരം ബെലെടു്തുന്തിന് 8 ഇ്ഞ് വീതിയിൽ ലപാ്ടിന്ലറ നീളദ്താളം ലച്മ് ദപാള മര്തിൽ പതി്ഛ് ചുറും ഒന്ര ഇ്ഞ് വീതിയിൽ 1/8 കന്തിൽ ലച്മു പ്ട ലപാഴി്ചു ലക്ടി ബെലെടു്തുന്തിന് ദശഷം ധവജ നിർ്മാണ്തിന് തദെേിവസം ലചദ്യ്ിതാണ്. ധവജ്തിന് മുകളിൽ മ്ണി പെകയും യ്ിി (ലകാടിദ്ക) എന്ിവ ദതൊധിവാസം ലചദ്യ്ിതാണ്. പറ ഇറ്ങുന്തിന് മു്മ് നാളം മുതൽ മുകളിലെ ലപാ്ട് അവസാനി്കുന്ത് വലര ലച്മ് ഷീറ് ലകാ്ി് ചുറുഭാഗം ലപാതി്ഞ് എടുദ്ക്ിതാണ്.” (underline supplied)

15. In the report dated 08.05.2024, K.K. Dasan Achary, the Sthapathi of the Board has reported that in the inspection conducted on 07.05.2024, defects were noted in the teak pole at two places. The said defects cannot be taken lightly. Therefore, the log has to be strengthened by putting copper rings having a width of 8 inches and a thickness of 1‰ inch, over the cracks on the said log.

16. Even prior to the aforesaid reports dated 07.05.2024 and 08.05.2024 of the Sthapathies of the Board, the Assistant Devaswom Commissioner obtained a letter dated 05.05.2024 DBP No.80 of 2024 17 from T.K. Sukumaran Achary, the Carpenter engaged for preparing the teak pole for using the same as Dwaja Sthamba. The said letter reads thus; “ടി ദ്ഷപ്ത്തിലെ ഇടിമിന്െിൽ തകർന് ദകാൺപ്കീറ് ധവജസ്തംഭം മാറി മര്തിൽ പണിയുന്തിനായി മരം പണിത സുകുമാരൻ ആചാരി എഴുതുന്ത് ധവജസ്തംഭ്തിനായി പണി തീർ്തു ലവ്ചിരി്കുന് ദത്ക് മരല്ത പറി നവമാധയമ്ങളിൽ ചിെ ലതറായ പ്പചരണ്ങൾ നട്കുന്തിനാൽ ഉപദേശകസമിതിയുലട നിർദേശപ്പകാരം മരം പുനഃപരിദശാധി്കുകയും തടികളിൽ സാധാരണയായി കാണുന് ലതാെിയടു്കും വയറും ആലണന്് ദബാധയമാവുകയും ലചയ്തു. ആയതിനാൽ ആ മരം ധവജസ്തംഭ്തിനായി ഉപദയാഗി്കുന്തിൽ എന്ലറ അനുഭവ്തിൽ കുഴെലമാന്ും കാണുന്ിെല. ശബരിമെ, ഏറുമാനൂർ, കടു്തുരു്തി എന്ി്ങലന നിരവധി ദ്ഷപ്ത്ങളിൽ ലകാടിമരം പണി ലചയ്തതിന്ലറ പരിചയ്തിൽ നിന്ും ദബാധയലെ്ടതാണ്. ആവശയലമേിൽ തടിയുലട ഒദന്ാ, രദ്ിാ ഭാഗ്തു ലച്മിന്ലറ ചുറ് ഇടുന്തും നെലതാണ്.”

17. In the said letter dated 05.05.2024, T.K. Sukumaran Achary has stated that at the request of the Temple Advisory Committee, he re-examined the teak pole intended to be used as Dwaja Sthamba. The log was found in good shape, which can be used for making the flag mast. If found necessary, at one or two places, copper rings can be fitted.

18. Even prior to the aforesaid letter dated 05.05.2024, the Assistant Engineer, Thiruvalla, submitted Annexure R1(c) report dated 04.05.2024 the Assistant Devaswom Commissioner, Thiruvalla. The said report reads thus; DBP No.80 of 2024 18 “സൂചന ന്മർ ക്തിൻ പ്പകാരം ഇദന് േിവസം (04.05.2024) ലപാ്ടെുകൾ ഉ്ള ഭാഗ്ത് ദൊഹചുറുകൾ നൽകിയും ഉപദയാഗി്കുവാൻ സാധി്കും. (നിർ്മാണ്തിനുളള തടി വിശേമായി പരിദശാധി്ചു. ധവജ്തിന്ലറ ഏകദേശം കൃതയമായ അളവുകളിൽ പണി പൂർ്തീകരി്ചി്ടു്ി്. ധവജ ്ഽാപന്തിന് മു്മുളള അവസാന മിനു്കുപണികൾ മാപ്തദമ ബാ്കിയു്ളൂ. തടി വിശേമായി പരിദശാധി്ചതിൽ ചുവ്ടിൽ നിന്് സമചതുര ഭാഗം അവസാനി്കുന്ിട്ത് ഒരു വശ്തായി ദകടുപാടുകൾ ക്ിു. 8 പ്ടമായി്ടുളള ഭാഗ്തും ഇതിന്ലറ തുടർ്ചയു്ി്. ഉരുളായി ലചയ്തി്ടുളള ഭാഗ്ത് മൂന്് ്ഽെ്ങളിൊയി ഏകദേശം ഒരു മീററിെധികം വരുന് ലപാ്ടെുകളു്ി്. ഏറവും മുകൾഭാഗ്ത് ഒരു “ക്മ്ദകട്” ഉ്ി്. ചിെ ്ഽെ്ങളിൽ ദനരിയ ദതാതിൽ ലവ്ളയുലട അംശം ഉ്ി്. ലപാ്ടെുകൾ ക്ി ്ഽെ്ങളിൽ എതിർഭാഗ്ത് ലപാ്ടെുകൾ കാണാൻ കഴി്ഞിെല. ആയതിനാൽ തലന് ഇത് ഉളളിദെ്ക് വയാപി്ചി്ടുളളവയെല എന്് അനുമാനി്കാം. മാപ്തമെല മുകളിെും താലഴയും മുറി്ച വശം പരിദശാധി്ചതിൽ “വയർ” മാപ്തമാണ് കാണാൻ കഴി്ഞത്. തടിയുലട ഈടിലനദയാ ഉറെിലനദയാ ബാധി്കുന് രീതിയിെുള ദകടുപാടുകൾ ഇെല. എ്ണദ്താണിയിൽ നിദ്ഷപി്ചുകഴി്ഞാൽ കീട്ങളുലട ആപ്കമണം ഉ്ിാകുന്ത് ഒഴിവാകും. ലപാ്ടെുകൾ ഉ്ള ഭാഗ്തു ദൊഹ്ചുറുകൾ നൽകിയും ഉപദയാഗി്കുവാൻ സാധി്കും. ഈ വിഷയ്തിൽ വാസ്തുപരവും ആചാരപരവുമായ അഭിപ്പായം നൽദക്ിത് ദ്ഷപ്തം തപ്രിയും തിരല്ഞടു്കലെ്ട വാസ്തു വിേᨽ᪚ധരുമാണ്. ആയതിനാൽ ദ്ഷപ്തം തപ്രിയുലടയും ധവജപുനർ നിർ്മാണ്തിന്ലറ ഭാഗമായി നറു്കില്ടടു്ത വാസ്തു വിേᨽ᪚ധരുലടയും അഭിപ്പായം ആരാ്ഞ് തീരുമാനം ദകല്കാളളണലമന്ുളള അഭിപ്പായം അറിയി്ചുലകാ്ളുന്ു.”

19. In Annexure R1(c) report dated 04.05.2024, the Assistant Engineer, Thiruvalla, reported that cracks having a length of more than one meter are found on the pole. Since no cracks are found on the opposite side, it can be presumed that DBP No.80 of 2024 19 the cracks have not gone deeper into the inner portion of the log. A final decision has to be taken after ascertaining the views of the Tantri and subject experts.

20. The document marked as Annexure R1(d) is a copy of the opinion dated 07.05.2024 of the Tantri of Thiruvalla Sree Vallabha Temple, addressed the Assistant Devaswom Commissioner, Thiruvalla, which reads thus; “തിരുവെല പ്ശീവെലഭ മഹാദ്ഷപ്ത്തിലെ സവർ്ണധവജ പുന:പ്പതിഷ്ഠാർ്ഥം ലച്തിൊകമാ്കിയ മര്തിന്ലറ ഗുണനിെവാരം സംബരി്ചു്ള അഭിപ്പായം സാദേതികമായ ഒന്ാണ്. അതിൽ അഭിപ്പായം പറദയ്ിത് തടിെണി ലച്യുന് ശില്പി വിഭാഗവും, പുറദമ നിന്ു്ള, തടിയുലട ഗുണനിെവാരം വശമു്ള തടിെണി്കാരുമാണു്. തപ്രിയ്്ക് പ്കിയാഭാഗവും, ്ഽപതിയ്്ക് അളവിലെ ്ഽിതിയുമാണു് പറയാനാവുന്തു്. പ്ശീവെലഭ മഹാദ്ഷപ്തം തപ്രിയായിരി്കുദ്മാൾ തലന്, തിരുവിതാംകൂർ ദേവസവം ്ഽപതിമാരിലൊരാളും ധവജ്തിന്ലറ കണ്കുകൾ ത്യാറാ്കിയ വയ്വിയുമാണു് എന്തിനാൽ, താേൾ ആവശയലെ്ടതുപ്പകാരം മര്തിന്ലറ തൽ്ഽിതി പരിദശാധി്ചതിൽ താലഴെറയുന് അഭിപ്പായമാണു് എനി്കു്ിായതു്.

1. പണിയിൽ അളവുപിഴയിെല.

2. മര്തിൽ മൂന്ിട്തായി ലതാെി ഉ്ളിദെ്കു് ചുരു്ങി്ക യറിയതിനാെു്ള കീറൽ കാണുന്ു്ിു്. അതു് െംബമായി ഉ്ളിദെ്കു്ളതെല. ആഴ്തിെു്ളതുമെല. മരം ഉദപ്ഷി്കണം എന്ു വിധി്കാനു്ള ഗൗരവം പ്പസ്തുത കീറെിനിെല.

3. ആധാരശിെ മുതൽ ദവേികാഭാഗം വലര ലച്മ് പാളിലകാ്ി് ലപാതി്ഞ ദശഷമാണ് തടി ്ഽാപി്കുന്തു്. ലച്മുപാളി ലകാ്ിു്ള ലപാതിയൽ മുകളിദെ്ക്, ഏകദേശം മധയദ്താളം, ലചയ്തു് മരം ്ഽാപി്ചാൽ ഒരു സംശയവും ഈടിൽ ഉ്ിാവുകയിെല. എ്ണദ്താണിയിൽ നിന്ും ഉയർ്തുദ്മാൾ കാണുന് ദനരിയ DBP No.80 of 2024 20 കീറെുകൾ ദകാെര്കിറ്കിദ്ത്ചു അടല്ചടു്കുകയും ദവണം. ഇപ്തയും ലചയ്തുലകാ്ി് നിെവിലെ മരം തലന് ഉപദയാഗി്കാവുന്താണു്.

4. മലറാരു പ്പശ്നമാണ് ഗൗരവമായു്ളതു്. മര്തിന്ലറ ജൊംശം പൂർ്ണമായി ഒഴി്ഞതായാണ് കാണുന്തു്. 3-4 ആഴ്ച കൾ്കു്ളിലെേിെും മര്തിനു് ദതൊധിവാസം ഉ്ിായിലെലേിൽ നിറലയ ലപാ്ടെുകൾ വീഴുകയും മരം വളയുകയും ലച്യാൻ വെിയ സാ്ധയതയു്ി്. ഈർെം ന്ിമായ സാഹചരയ്തിൽ, വളവ് ഉ്ിായാൽ നിവർ്തിലയടു്കൽ ഏറ്കുദറ അസാ്ധയമായി്തീരും. ലപാ്ടെുകൾ വെുതാവുകയും ലച്യും. ഫെ്തിൽ മരം ഉപദയാഗശൂനയമാവുകയും ലച്യും.

5. ആയതിനാൽ, എെലാ അഭിപ്പായ്ങളും പരിഗണി്ച ദശഷമു്ള അരിമ തീരുമാനം വളലര ദവഗ്തിൽ എടു്കുകയാണു് തിരുവിതാംകൂർ ദേവസവം ദബാർഡ് ലചദ്യ്ിതു്. തീരുമാനം ദവകുംലതാറും മരം ഉപദയാഗശൂനയമാവാനു്ള സാ്ധയത ഉയർന്ു വരും. പുതിയ മരം മുതെു്ള നടപടികളും ലചെവുകളും അ്ധവാനവും ആേയം മുതൽ ആരംഭിദ്ക്ിതായി വദന്്കാം. നിെവിലെ സാഹചരയ്തിൽ പ്കിയയ്്കായി നി്ᩐയി്ച 2024 ലമയ് 10, 11, 12 തി്യതികളിൽ ദതൊധിവാസം പ്പാദയാഗികമായി അസാ്ധയമായിരി്കുകയാണദെലാ. ആയതിനാൽ, ഈ മരം തലന് തുടരാലമന്ാണ് തീരുമാനമു്ിാവുന്ലതേിൽ, പ്കിയകൾ 2024 ലമയ് 30, 31, ജൂൺ 1, 2 തി്യതികളിൽ നട്താവുന്താണു്. (മുഹൂർ്തം കുറ്ച് ദനരല്ത ആയതിനാ ൊണു് 4 േിവസം ദവ്ിി വരുന്ത്). അതിന്ലറ പ്കിയാ വിവരവും വിശോംശ്ങളും, വിഷയ്തിൽ തീരുമാനമാവുന് മുറയ്്ക് നൽകുന്താണു്.”

21. The document marked as Annexure R1(f) is an order dated 17.05.2024, whereby the Board has decided to conduct ‘Ottarasi Prasnam’, in order to examine the matter in detail, after taking note of the report of the Sthapathi Dr.Manoj S. Nair. Paragraphs 3 to 5 of that order read thus; “ടി ഉ്തരവുകൾ പ്പകാരം സവർ്ണ ലകാടിമര നിർ്മാണ DBP No.80 of 2024 21 ആവശയ്തിദെയ്്കു്ള ദത്ക് മരം കല്ി്തിയി്ടു്ളതും ആയത് ലച്തി മിനു്കി ത്യാർ ലചയ്ത് എ്ണദതാണിയിൽ നിദ്ഷപി്കുന്തിന് ആവശയമായ താപ്രിക കർ്മ്ങൾ നട്തുന്തിന് ദേവസവം തപ്രി തീയതി നി്ᩐയി്ച് നൽകിയി്ടു്ളതുമാണ്. എന്ാൽ പ്പസ്തുത ദത്കിൻ തടിയിൽ ദകടുപാടുകൾ സംഭവി്ചി്ടു്ളതായി സമൂഹമാധയമ്ങളിൽ പ്പചരി്ചതിന്ലറ അടി്ഽാന്തിൽ ടി സംഗതിയിദേെു്ള ചീഫ് എൻജിനീയറുലട പരാമർശം (3) റിദൊർ്ട് െഭി്ചി്ടു്ളതാണ്. പ്പസ്തുത റിദൊർ്ടിൽ, തിരുവെല പ്ശീവെലഭ ദ്ഷപ്ത്തിലെ ധവജ നിർമാണവുമായി ബരലെ്ട ദത്കിൻ തടിയുലട നിെവാരല്ത പറി, ടി വിഷയ്തിൽ ദവേᨽ᪚േയമു്ള ദേവസവം ദബാർഡിന്ലറ അംഗീകൃത വാസ്തു വിേᨽ᪚േനും ദ്ഷപ്തം തപ്രിയുമായ പ്ബ്ᩧപ്ശീ.അ്ᨿിശർ്മൻ വാസുദേവൻ ഭ്ടതിരിൊട്, ്ഽപതി ദഡാ മദനാജ്.എസ്.നായർ, ്ഽപതി ഇളംപ്ളി ലക.ലക.ോസൻ ആചാരി, ശില്പി പ്ശീ.റി.ലക.സുകുമാരൻ ആചാരി എന്ിവരുലട അഭിപ്പായ്ങൾ െഭയമാ്കിയതിൽ പ്പസ്തുത തടി ഉദപ്ഷി്കാൻ ത്ക ഗൗരവമു്ള ദകടുപാടുകൾ ഇലെലന്ും, കാണലെ്ട അപാകതകൾ ദൊഹ്ചുറ് നൽകി പരിഹരി്ച് ഉപദയാഗി്കാവുന്താലണന്ും അഭിപ്പായലെ്ടി്ടു്ളതും എന്ാൽ ്ഽപതി ദഡാ.മദനാജ് എസ്. നായരുലട റിദൊർ്ടിൽ ആയത് ദൊഹ്ചുറ് നൽകി പരിഹരി്കാലമേിെും ശാസ്ദപ്താ്വമായി ഇ്തരം അപാകതകൾ വരുവാൻ പാടു്ളതെല എന്തിനാൽ ഒറ രാശി പ്പശ്ന്തിെൂലട ദേവഹിതം അറി്ഞ് തുടർനടപടികൾ സവീകരി്കുന്താണ് ഉചിതലമന്ും അഭിപ്പായലെ്ടി്ടു്ളതാണ്. പ്പസ്തുത വിഷയം ചർ്ച ലചയ്ത് ചുവലട വിവരി്കുന് തീരുമാന്ങൾ ദകല്കാ്ിു. ഉ്തരവ്

1. തിരുവെല പ്ഗൂെിൽലെ്ട തിരുവെല പ്ശീവെലഭസവാമി ദ്ഷപ്ത്തിലെ സവർ്ണ ധവജ സ്തംഭ പുനർ നിർ്മാണ്തിദെയ്്കായി കല്ി്തിയ ദത്കിൻ തടിയിൽ സംഭവി്ചി്ടു്ള ദകടുപാടുകൾ സംബരി്ച് ടി വിഷയ്തിൽ പ്പാവീണയമു്ള ്ഽപതിമാരുലടയും ശില്പിയുലടയും അഭിപ്പായവും ചീഫ് എൻജിനീയറുലട റിമാർകസും പരിഗണി്ച്, തടിയുലട പുറ്തു്ള ദകടുപാടുകൾ പരിഹരി്കുന്തിന് ദവ്ി ്ഽാന്ങളിൽ ദൊഹ്ചുറ് ഉപദയാഗി്കാവുന്താലണേിെും ശാസ്ദപ്താ്വമായി ഇ്തരം അപാകതകൾ വരുവാൻ പാടു്ളതെല DBP No.80 of 2024 22 എന്തിനാൽ ഒറ രാശി പ്പശ്ന്തിെൂലട ദേവഹിതം അറി്ഞ് തുടർ നടപടികൾ സവീകരി്കുന്തിന് തീരുമാനി്ച് ഉ്തരവാകുന്ു.

2. ടി സംഗതിയിദേെു്ള തുടർ നടപടികൾ അടിയരിര്തിൽ സവീകരി്കുന്തിന് ദേവസവം ക്മീഷണലറ ചുമതെലെടു്തി ഉ്തരവാകുന്ു.”

22. It thereafter the Assistant Devaswom Commissioner submitted a report dated 19.06.2024 to the Devaswom Commissioner, enclosing therewith the reports of the Sthapathies, namely, Dr. Manoj S. Nair and K.K. Dasan Achary. The said report dated 19.06.2024, reads thus; “തിരുവെല പ്ഗൂെിൽലെ്ട തിരുവെല ദേവസവ്തിലെ സവർ്ണ ധവജ്തിന്ലറ തടിയുലട ദകടുപാടുകൾ സംബരി്ച് പ്ശീ.ദഗാപകുമാർ സമർെി്ചി്ടു്ള പരാതിയുലട അടി്ഽാന്തിൽ ടി ദേവസവം സ്ിപ്ഗൂൊഫിസറിൽ നിന്ും വിശേമായ റിദൊർ്ട് വരു്തിയി്ടുളളതും ആയതിൽ ലകാടിമര ശിൽെി സുകുമാരൻ ആചാരി തടി പരിദശാധി്ച്, തടികളിൽ സാധാരണയായി കാണുന് ലതാെി അടു്കും വയറുമാണ് കാണലെടുന്ുലവന്് ടി മരം ധവജ നിർ്മാണ്തിനു ഉപദയാഗി്കാവുന്താലണന്ും അഭിപ്പായലെ്ടി്ടു്ളതായി സ്ിപ്ഗൂൊഫീസർ റിദൊർ്ട് ലചയ്തി്ടുളളതാണ്. തുടർന്് ബുധനൂർ വിദനാദ് എന് ദജയാ഼്യൻ ഉപദേശക സമിതി അംഗ്ങളുലടയും ദേവസവം ഉദേയാഗ്ഽരുലടയും ഭ്വരുലടയും സാന്ിേയ്തിൽ ഒറരാശി പ്പശ്നം നട്തുകയും നിെവിലെ തടി തലന് ധവജ്തിനു ഉപദയാഗി്കുന്തിൽ ദേവാേീനം ഉല്ിന്ും അഭിപ്പായലെടുകയും ലചയ്തി്ടു്ളതാണ്. ബഹുമാനലെ്ട ദേവസവം ക്മീഷണർ ആഫീസിൽ നിന്ും

30.05.2024 ലെ ആർ.ഒ.സി 20621/23/പി.ആർ ന്മർ ഉ്തരവ് പ്പകാരം ടി തടി ദതൊധിവാസ്തിനു സമർെി്ചി്ടു്ളതുമാണ്. ദേവസവം ദബാർഡ് അംഗീകൃത ്ഽപതിമാരായ പ്ശീ.ലക.ലക.ോസൻ ആചാരി, ദഡാ.മദനാജ്.എസ്.നായർ എന്ിവർ തടി പരിദശാധി്ചതിന്ലറ അടി്ഽാന്തിൽ ദരഖാമൂെം ഹാജരാ്കിയി്ടുളള അഭിപ്പായ്തിന്ലറ പകർെ് ഇതു സഹിതം ദചർ്തയ്ചു വിവരം അറിയി്ചുലകാ്ളുന്ു.”

In the aforesaid report dated 19.06.2024, it is stated that an Astrologer by name Budhanoor Vinod Kumar conducted ‘Ottarasi Prasnam’ in the presence of the members of the Temple DBP No.80 of 2024 23 Advisory Committee, Devaswom Officials and also the devotees, in which it was found that there is Daivadheenam for using the teak pole as Dwaja Stambha. Thereafter, based on the order dated 30.05.2024 of the Devaswom Commissioner, the teak pole was put in Enna Thoni (oil tank).

24. As evident from Annexure R1(g) letter dated

28.05.2024 of the Assistant Devaswom Commissioner, Thiruvalla, addressed to the Devaswom Commissioner, pursuant to the order dated 23.05.2024 of the Devaswom Commissioner, ‘Ottarasi Prasnam’ was conducted by an astrologer Budhanoor Vinod Kumar on 24.05.2024, in which Daivahitham was in favour of using the teak pole in question as Dwaja Sthamba. In such circumstances, the opinion of the Tantri was obtained for putting the teak pole in Enna Thoni (oil tank). The stand taken in the affidavit dated 16.10.2024 filed by respondents 1 and 2 is that after obtaining the opinion of the Tantri, the Devaswom Commissioner granted permission to the Assistant Devaswom Commissioner for Thailadhivaasam of the teak pole. According to respondents 1 and 2, there is no serious defects in the teak pole, which makes it unsuitable for Dwaja Stambha and the defects DBP No.80 of 2024 24 noted are only trivial in nature.

25. As evident from the photographs of the teak pole extracted hereinbefore at paragraph 11, which forms part of Annexure O1 complaint, there are cracks on the teak pole intended to be used as Dwaja Sthamba. The said fact is also evident from the inspection report dated 07.05.2024 of Dr. Manoj S. Nair, the Sthapathi of Travancore Devaswom Board. As evident from the said report, there are holes in the teak pole intended to be used as Dwaja Sthamba, having a depth of 2 to 3 inches, which starts at 150 cms from the bottom of that teak pole, up to 220 cms. In addition to that, a crack having depth of 2 inches is seen on the teak pole, which starts at 380 cms from the bottom of the pole up to 520 cms, having a length of 140 cms. There is another crack, which starts at 690 cms from the bottom of the pole up to 780 cms. In the said report, it is also stated that although the cracks seen in the teak pole can be mended without affecting the strength of the pole, as per the Sasthra the pole intended to be used as Dwaja Sthamba should not have such defects. As per the Sasthra, the log without any decay or damage or holes or cracks should be used for the flag 25 DBP No.80 of 2024 mast.

26. In the report dated 08.05.2024, K.K. Dasan Achary, the Sthapathi of the Board has reported that in the inspection conducted on 07.05.2024, defects were noted in the teak pole at two places, which cannot be taken lightly. Therefore, the log has to be strengthened by placing copper plate having a width of 8 inches over the cracks on the said log and thereafter covering the same with copper rings having a width of 1‰ inch and thickness of 1/8. In Annexure R1(c) report dated 04.05.2024 of the Assistant Engineer, Thiruvalla, it is reported that cracks having a length of more than one meter are found on the teak pole.

27. The issue that requires consideration is as to whether the teak pole in question, which has multiple cracks and other defects, as noticed by the Sthapathies of the Travancore Devaswom Board in the inspection reports dated 07.05.2024 and

08.05.2024, can be used as Dwaja Sthamba for the flag mast in Thiruvalla Sree Vallabha Temple, which is a major temple under the management of the 1st respondent Travancore Devaswom Board. DBP No.80 of 2024 26 28. Admittedly, the flag mast of Thiruvalla Sree Vallabha Temple got damaged by lightning. In the Devaprashnam conducted and in the Pariharakriya, it was found that a new flag mast has to be installed using teak pole. Though, in the report dated 07.05.2024, the Sthapathi of the Board has stated that the cracks seen in the teak pole can be mended without affecting the strength of the pole, as per the Sasthra the pole intended to be used as Dwaja Sthamba should not have such defects. As per the Sasthra, the log without any decay or damage or holes or cracks should be used for the flag mast. From the pleadings and materials on record, we notice that the Board is proposing to use the log in question as Dwaja Sthamba, after putting copper rings over the cracks on the said log. Before the learned Ombudsman, the complainant filed a statement dated 09.07.2024, wherein it was pointed among other things that the ‘Ottarasi Prasnam’ conducted by an Astrologer Budhanoor Vinodkumar, was not in the presence of the consultant astrologer of the Travancore Devaswom Board, which is in violation of the Board order ROC No.13459/18/NS.

29. Having considered the pleadings and materials on DBP No.80 of 2024 27 record and also the submissions made at the Bar, we find that the decision taken by the Travancore Devaswom Board to use the teak pole referred to in the report dated 07.05.2024 of the Sthapathi Dr.Manoj S. Nair and the report dated 08.05.2024 of the Sthapathi K.K. Dasan Achari, as Dwaja Sthamba for the flag mast in Thiruvalla Sree Vallabha Temple, after strengthening the same by putting copper rings over the multiple cracks, requires reconsideration at the hands of the Board, especially when the expenditure for the reinstallation of Dwajam in the temple comes around Rs.20,00,000/-. In the above circumstances, this DBP is disposed of by directing the 1st respondent Travancore Devaswom Board to reconsider the question as to whether the teak pole in question, which admittedly has several cracks and other defects as evident from the photographs extracted hereinbefore at paragraph 11 and also inspection reports dated 07.05.2024 and

08.05.2024 of the Sthapathies of the Board, can be used as Dwaja Sthamba for the flag mast in Thiruvalla Sree Vallabha Temple, after strengthening the same by putting copper rings over the cracks on the said teak pole, with notice to the DBP No.80 of 2024 28 petitioner/complainant and also the office bearers of the Temple Advisory Committee of Thiruvalla Sree Vallabha Temple, as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a certified copy of this order.
