STATE OF KERALA REPRESENTED BY PUBLIC PROSECUTOR, HIGH COURT OF KERALA, PIN - 682031 THE STATION HOUSE OFFICER TTOWN EAST POLICE STATION, THRISSUR DISTRICT, PIN - 680001 THIS CRIMINAL REVISION PETITION HAVING COME UP FOR ADMISSION ON 10.01.2024, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: CRL.REV.PET NO. 1228 OF 2023 2 ORDER Accused Nos.1 and 2 came up in revision aggrieved by the order of rejection of an application for discharge. The final report was submitted alleging commission of offence punishable under Sections 406, 465, 468, 471 and 420 IPC r/w Section 34 IPC.

The crux of the case is that the accused persons at first deposited an amount of Rs.10 Lakhs with a Co-Operative Bank. By showing the abovesaid account number forged an FD receipt and it was given to the complainant. The amount deposited with the bank was subsequently withdrawn by the accused. If it is proved, it would result in conviction. The final report was submitted under Section 173(2) Cr.P.C. Hence, it is not a fit case wherein the jurisdiction can be exercised for a discharge. The trial court CRL.REV.PET NO. 1228 OF 2023 3 has rightly rejected the application. Crl.R.P. will stand dismissed. The Registry is directed to intimate a copy of this order to the trial court so as to proceed further with the final report submitted. Sd/- P.SOMARAJAN JUDGE SPV
