The petitioner contends that the afore property was erroneously included in the data bank and hence he submitted an application for conversion of the description of the property by filing an application in Form No.6. He also filed an application seeking removal of the property from the data bank by filing an application in Form No.5. Both these applications are seen rejected as per Ext.P10 order dated

26.03.2023 and Ext.P11 order dated 31.20.2023.

2. I have heard Sri.P.T.Sheejish, the learned counsel for the petitioner and Sri.E.G.Gorden, the learned Government Pleader.

The learned counsel for the petitioner would place reliance on the orders issued with respect to certain adjacent properties, which were permitted to be converted by W.P.(C)Nos.37925 & 24359 of 2023 6 2025:KER:27277 making changes in the description of the property, as evidenced at Ext.P5 proceedings dated 10.04.2022 with respect to one Sri.Jinse George. He would also place reliance on Ext.P6 dated 21.01.2021 with respect to the same individual, as per which, the nearby property was removed from the data bank. He also places reliance on Ext.P12 KSREC report to show that the property in question, even during 2008 was admittedly cultivated with 'crops' and not paddy.

The learned Government Pleader would place reliance on the photographs of the property - Ext.P9 as also the definition under the provisions of the Kerala Conservation of Paddy Land and Wet Land Act, 2008, to contend that the property in question can only be considered to be a paddy land and he would also state that the report of the KSREC does not contain any finding in favour of the petitioner herein.

5. I have considered the rival submissions as well as the connected records.

6. A perusal of the impugned orders show that the issue has not been addressed, with reference to the orders at Exts.P5 and P6, relied on by the petitioner. It is the W.P.(C)Nos.37925 & 24359 of 2023 7 2025:KER:27277 contention of the petitioner that, insofar as the neighboring properties have already been permitted to be taken out to the data bank, similar treatment ought to have been extended to the petitioner, especially in the light of the findings contained in the KSREC report. True, Ext.P10 makes reference to the KSREC report. However, the impact of the order issued in the favour of Sri.Jinse George relied on by the petitioner along with the findings in the KSREC report is not taken note of while issuing the impugned orders.

7. This Court also notices that the proceedings have been initiated, solely on the basis of a report of the Village Officer. No physical verification is seen carried out by the RDO.

8. In such circumstances, I am of the opinion that the matter requires a reconsideration at the hands of the respondent herein. Resultantly, these writ petitions would stand disposed of by setting aside Ext.P10 order dated 26.06.2023 in W.P.(C)No.24359 of 2023 and Ext.P11 dated 30.01.2023 in W.P.(C)No.37925 of 2023 and directing the respective W.P.(C)Nos.37925 & 24359 of 2023 8 2025:KER:27277 respondents to pass orders afresh in the applications filed as above by the petitioners, after taking note of the findings in the KSREC report, the impact of Exts.P5 and P6 orders in the name of Sri.Jinse George as well as on the basis of the statutory provisions, as expeditiously as possible, at any rate, within a period of sixteen weeks from today.
