W.P.(C)No.31031 of 2015 is filed challenging Ext.P1 order passed by the Deputy Director of Panchayath by which it is directed to see that there is no obstruction to the ingress and egress to the building owned by the 6th respondent. The 6th respondent in this Writ petition filed W.P.(C) No.24579 of 2015 to implement the order passed by the Deputy Director of Panchayath mentioned above. When W.P. (C)No.24579/2015 came up for consideration on WP(C) Nos. 24579 & 31031 OF 2015 5

12.08.2015, this Court passed the following order: “G.P. takes notice for R1, R4 and R6. Issue notice to other respondents by speed post. Respondents 3 and 4 shall ensure that Ext.P5 order is implemented in letter and spirit by way of setting apart space having a width of 5.5 feet each in front of the shop room belonging to the petitioner. This order shall be in force for one month. Post after a month.”

3. The above interim order was extended until further orders on 14.03.2016 and the same is in force even now. A perusal of the order passed by the Deputy Director of Panchayath would show that the Deputy Director only stated that the access to the building of the petitioner shall not be obstructed by parking vehicles. It will be better to extract the relevant portion of Ext.P1 order in W.P.(C) No.31031 of 2015: “തുടർനന്ന്

4. The counsel appearing for the petitioner in W.P.(C) No.31031 of 2015 submitted that the access may be restricted to 5.5 feet as stated in Ext.P1. The interim order passed by this Court in W.P.(C) No.24579 of 2015 clearly restrict the space of access to a width of 5.5 feet each in front of the shop room belonging to the petitioner in that case. If that be the case, the interim order dated 12.08.2015 in W.P.(C) No.24579 of 2015 can be made absolute. The grievance of the petitioner in W.P.(C) No.31031 of 2015 against Ext.P1 order is unsustainable because the Deputy Director of Panchayath only directed to give access to the building by providing some space while parking the vehicles. I see no reason to interfere with the same. Therefore, W.P.(C) No.31031 of 2015 can be dismissed and W.P.(C) No.24579 of 2015 can be disposed of retaining the WP(C) Nos. 24579 & 31031 OF 2015 8 interim order dated 12.08.2015. Accordingly, W.P.(C) No.31031 of 2015 is dismissed. W.P.(C) No.24579 of 2015 is disposed of making the interim order dated 12.08.2015 absolute. If there is any violation of the same, the petitioner is free to approach the police authorities to see that the same is implemented in letter and spirit.
