A statement was filed by the first respondent stating that effective steps are being taken. Sand mining in the rivers in Kerala State is a general problem. It is the bounden duty of the police to see that illegal sand mining is prohibited. Interest of the people living in the locality is to be protected than the interest of the workers. What is more important is the protection of the environment. If sand mining is allowed to take place, the right to life guaranteed under Article 21 of the Constitution of India will be infringed. Therefore, the police should see that effective steps are taken to prevent illegal sand mining and if the order is violated and effective measures are taken, the police should be responsible.
