These writ petitions are filed for quashing the order dated 6/12/2006 passed by the District Labour Officer, Ernakulam.
Operative part
It is the contention of the petitioners that since the Scheme was extended to the area in question now, it is for the local committee to decide as to who should be engaged for work and that power should not be given to the unions. Admittedly, the local committee is not yet framed. Meanwhile, after the order was passed by the District Labour Officer, a reconciliation settlement was arrived at in which all the unions including the petitioners union have signed, wherein an arrangement has already been made. This Court in a petition under Article 226 of the Constitution of India, is not intending to disturb peace in an area where work should be done smoothly and settlement is binding on all parties, no further reliefs are called for. It is also submitted that in view of the settlement, the work is going on smoothly. But we make it clear that none of the workers should be denied work merely because of non-joining of a union and Government should take steps to implement the scheme as wpc 34205/06 & 642/07 -2- per the Act. This should be done as expeditiously as possible, in any event, within six months from the date of receipt of a copy of this judgment. The writ petition is disposed of with the above directions.
