Judgment
BY ADV. SRI.PRATHEESH.P RESPONDENTS: -------------
STATE OF KERALA, REPRESENTED BY THE PRINCIPAL SECRETARY, FINANCE DEPARTMENT, SECRETARIAT, THIRUVANANTHAPURAM.
THE DISTRICT COLLECTOR, COLLECTORATE, KOLLAM.
THE SPECIAL TAHASILDAR, L.A. K.I.P.NO.II, KOLLAM, KOTTIYAM. BY SR.G.P.SRI.D. ANIL KUMAR THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 12/08/2008, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: PIUS C. KURIAKOSE, J. --------------------------------------------- W.P.(C).NO.26833 OF 2007-T ---------------------------------------------- Dated this the 12th day of August, 2008. JUDGMENT It is asserted before me by the learned counsel for the petitioners that pursuant to my interim order dated 17.7.2008 petitioners 5,7 and 8 have produced through their advocate all necessary documents. Government Pleader submitted that he has no instructions from the Land Acquisition Officer as to whether the documents produced are sufficient to enable the Land Acquisition Officer to consider the application under Section 28A on merits. The learned counsel for the petitioners would submit that the documents produced by 5.7.2008 certainly enable the Land Acquisition Officer to take a decision on the application under Section 28 A on their merits. In view of the stand of the petitioners before this Court, I dispose of this writ petition directing the third respondent to enquire into the application under Section 28 A and finally dispose of the same on its merits in so far as the same pertains to petitioners 5, 7 and 8 by taking into account all the documents produced by them including documents produced pursuant to this Court's interim order dated 17.7.2008. PIUS C. KURIAKOSE, JUDGE. 2 .
