P.N.RAVINDRAN, J. -------------------------------------- WP (C) No. 2829 of 2012 --------------------------------------- Dated this the 5th day of March, 2012 JUDGMENT The petitioner is a stage carriage operator operating a stage carriage service on the route Perumpalam Ferry - Ameda - Ponekkara (via) Menaka, Palarivattom on the strength of Ext.P1 regular permit. The validity of the said permit expired on 14.1.2012. The petitioner did not apply for renewal in time. He applied for renewal only on
24.1.2012 by submitting Ext.P2 application accompanied by Ext.P3 application to condone the delay in filing the application for renewal. Along with the application for renewal he also filed Ext.P5 application for a temporary permit of four months duration. The requisite fee was also paid. This writ petition is filed for an order directing the Regional Transport Authority, Ernakulam to dispose of Ext.P2 application for renewal of Ext.P1 permit and Ext.P3 application to condone the delay in filing Ext.P2 application. The petitioner also seeks a direction to the Secretary, Regional Transport Authority, Ernkaulam to take a final decision on Ext.P5 application for the issue of a temporary permit of four months duration within a time limit to be fixed by this court.

When this writ petition came up for hearing today, the learned Government Pleader appearing for the respondents submitted on WP(C)No. 2829 of 2012 -2- instructions that Ext.P5 application was rejected on 18.2.2012, that the petitioner thereupon filed an appeal before State Transport Appellate Tribunal and by virtue of the interim order passed by the State Transport Appellate Tribunal, a temporary permit of four months duration was issued on 24.2.2012 and that the Regional Transport Authority will consider Exts.P2 and P3 applications and take an appropriate decision thereon expeditiously. In the light of the said submission, I dispose of the writ petition with a direction to the Regional Transport Authority, Ernakulam to take up for consideration Exts.P3 and P4 applications filed by the petitioner (for renewal of Ext.P1 stage carriage permit and to condone the delay in applying for renewal respectively) in its next meeting and pass appropriate orders thereon expeditiously thereafter.
