Three claim petitions are pending on the file of the Motor Accidents Claims Tribunal, Alappuzha, two claim petitions on the file of the Motor Accidents Claims Tribunal, Kollam and one claim petition on the file of the Motor Accidents Claims Tribunal, Thiruvananthapuram in respect of the very same accident. Many of the respondents in this transfer petition have not been served hitherto and it will be unjust to delay the disposal of the claim petitions finally.

2. I direct the Motor Accidents Claims Tribunal, Vatakara to have joint trial of the following cases:

3. The finding of negligence by the Motor Accidents Claims Tribunal, Vatakara may have a bearing in the cases pending before other Motor Accidents Claims Tribunals. Therefore the Motor Accidents Claims Tribunal, Alappuzha, Kollam and Thiruvananthapuram shall dispose of the claim petitions awaiting the verdict by the Motor Accidents Claims Tribunal, Vatakara. The Motor Accidents Claims Tribunal, Alappuzha shall jointly dispose of the following three cases:

2. O.P.(MV) No.1555 of 2008 Tr.P.C No.221 of 2010 3

3. O.P.(MV) No.1836 of 2008

4. The Motor Accidents Claims Tribunal, Kollam shall jointly dispose of the following two cases:

2. O.P.(MV) No.1393 of 2008

5. The Motor Accidents Claims Tribunal, Thiruvananthapuram shall dispose of the following case: O.P.(MV) No.1257 of 2007

6. The Motor Accidents Claims Tribunal, Vatakara shall complete the proceedings within a period of four months from the date of receipt of a copy of this judgment. The Motor Accidents Claims Tribunal, Alappuzha, Kollam and Thiruvananthapuram shall dispose of the claim petitions within two months thereafter. Needless to say that the parties will be afforded sufficient opportunity to adduce documentary and oral evidence. The Transfer Petition (Civil) is disposed of.
