NO.2137 OF 2008======================================Dated this the 30th day of June 2008ORDERPetitioner, who claims to be the registered owner of a mini lorry bearing Reg. No.KL-10 D/4023 challenges the order dated4.6.2008 passed by the Judicial First Class Magistrate, Vadakkancherry dismissing his application (CMP 3080/2008) filed under Section 457 Cr.P.C. seeking interim custody of the said lorry. One of the reasons given by the magistrate is that the same vehicle has been continuously used for illegal transportation of sand. This is a very relevant consideration justifying the refusal of interim custody of the vehicle. I see no grounds to interfere with the impugned order passed by the trial court.
