They have stated that the matter has been settled between the parties and the terms of settlement was reduced in writing and produced a joint statement along with a plan signed by the counsel for the petitioner and respondents and the parties except respondent No.3. Both counsel says that the third respondent is not a necessary party. The plan is marked as Ext.C1(a). Therefore, as a result of the joint statement Ext.C1 Plan is modified to the extent shown in Ext.C1(a). Both the counsel submit that according to the plan, physical boundary has been put up by the parties as shown in Ext.C1(a). It is further agreed by the respondents and their counsel that E.P. pending before the Sub Court, Palakkad relating to this matter will be withdrawn by the respondents in the light of this settlement.
