M.SASIDHARAN NAMBIAR,J. --------------------------------------------- B.A.NO.10573 OF 2011 --------------------------------------------- Dated 6th January, 2012 ORDER Petitioner is the accused in Crime No.300/2011 of Ambalavayal Police Station registered under Section 119 of Kerala Police Act. Petition is filed under Section 438 of Code of Criminal Procedure. The prosecution case is that petitioner represented that he is employed in Navy and made the de facto complainant to agree for marrying him and representing that her photograph is necessary to be shown to his family, obtained the photograph. Later on enquiry it was found that petitioner is not employed in Navy. Therefore, the de facto complainant and their family had withdrawn the marriage proposal. It is alleged that BA 10573/11 2 thereafter, the petitioner had affixed photographs of the petitioner at several places including the wall in front of the college and thereby committed the offence.

#2. Considering the allegations raised and the nature of the offence, I do not find that petitioner is entitled to anticipatory bail. Petitioner is at liberty to approach the learned Magistrate for regular bail on surrender. Petition is dismissed. M.SASIDHARAN NAMBIAR, JUDGE. uj.
