V.RAMKUMAR, J.---------------------------------------------------Bail Application No.8414 of 2010-----------------------------------------------------Dated this the 22nd day of December, 2010ORDERIn this Petition filed under Section 439 Cr.P.C. thepetitioner who is the accused in Crime No.946 of 2010 ofThenmala Police Station for an offence punishable underSection 55(a) of the Abkari Act for having been found inpossession of 3.75 litres of Indian Made Foreign Liquor, seekshis enlargement on bail. The petitioner was arrested on08/12/2010. 2.I heard the learned counsel for the petitioner andthe learned Public Prosecutor.3.Having regard to the nature of the offence, theduration of judicial custody undergone by the petitioner andthe other circumstances of the case etc., I am inclined togrant bail to the petitioner. Accordingly, the petitioner isdirected to be released on bail with effect from 12/01/2011on his executing a bond for `35,000/- (Rupees thirty fivethousand only) with two solvent sureties each for the likeamount to the satisfaction of the Judicial Magistrate of theFirst Class-I, Punalur and subject to the following conditions:- Bail Appln.No.8414/2010 : 2 :1.The petitioner shall report before theInvestigating Officer between 9 a.m. and11 a.m. on all Wednesdays.2. The petitioner shall make himself availablefor interrogation as and when required bythe police till the filing of the final report.3. The petitioner shall not influence orintimidate the prosecution witnesses norshall he attempt to tamper with theevidence for the prosecution.4.The petitioner shall not commit any offencewhile on bail.If the petitioner commits breach of any of the aboveconditions, the bail granted to him shall be liable to becancelled.
