O R D E RThe petitioner is the accused in Crime No.642/2012 of Kothamangalam Police Station for having committed offence punishable under Sections 3(1) (a)(c), 4(c), 6, 7(c) of LPGRegulation Supply and Distribution Order 2000 r/w Section 3(1)(a) of EC Act, 1955.
The allegation against the petitioner is that on1.10.2012 at 9.30 pm, the respondent seized several gas cylinders from the house of the petitioner.
The petitioner would say that he is totally innocent and has been falsely implicated with ulterior motive.
After having heard the learned counsel for the petitioner and the learned Public Prosecutor and after having perused the records made available by the learned PublicProsecutor, it is seen that the claim of the petitioner does not appear to be correct.

Considering the nature of allegation raised against B.A No.7500 of 2012: 2:the petitioner and nature of offence etc., preclude this Courtfrom exercising its extraordinary jurisdiction in favour of the petitioner. The petition is dismissed. However, if so advised, the petitioner may surrender before the Investigating Officer on or before 3.11.2012 who after interrogation, shall produce him before the JFCM Courtconcerned. If the petitioner moves an application for regular bail before the said court, the learned Magistrate shall consider and pass orders thereon in accordance with law, if possible on the same day itself.
