B.A.Nos.4328/06 & 4500/062investigation officer of Town South Police Station, Palakkad, on 22.7.2006 between 10.30 a.m and 11.00a.m. The investigating officer shall interrogate thepetitioners and produce them before the Court below, asper the law. However, I make it very clear that if theinvestigating officer intends to complete theinvestigation through the continued custody of theaccused, he may move an application before the Courtbelow and get the custody of the petitioners, so that therecovery of the weapons and other parts of theinvestigation could be completed, as submitted by thelearned Public Prosecutor. It is for the JudicialMagistrate of First Class-III, Palakkad, to passappropriate orders, as and when either the investigatingofficer or the accused, approach that Court withrelevant petitions, and prayers therein.
