UDAYABHANU, J.---------------------------------------------------------------- B.A.NO 2233 OF 2007------------------------------------------------------------------DATED THIS THE 24TH DAY OF APRIL 2007ORDERThis is an application for anticipatory bail under Section 438 Cr.P.C.Petitioner is the accused in Crime No. 151/2006 of Nedumangad Excise Range. Theoffences alleged are under Sections 8(1) and (2) of the Abkari Act. It is contendedthat petitioner is innocent of the offences alleged. Considering the nature of theoffence, I find that it is not a fit case to invoke S.438 Cr.P.C. All the same, theaccused may surrender before the appropriate court within two weeks from todayand apply for bail which shall be considered by the court below and disposed of asper law, as far as possible on the same day itself.
