Thepetitioner is the accused in Crime No. 12/2007 of Nedumangad Excise Range. Theoffences are under Sections 8(1) and (2) of the Abkari Act. It is contended thatpetitioner is innocent of the offences alleged. Considering the nature of the offenceI find that it is not a fit case to invoke Section 438 Cr.P.C. All the same, theaccused may surrender before the appropriate court and apply for bail which shallbe considered by the court below and disposed of as per law as far as possible onthe same day itself.
