The prosecution case is that on 10/10/2011 at 12 noon, petitioner trespassed into the house of the prosecutrix and forcibly dragged her to the bed room and committed rape on her and also threatened her that if she discloses this fact to anybody, her children will be killed and thereby committed the offences. Petitioner was arrested on 23/1/2012 and has been in custody since then.
Learned counsel appearing for BA 1392/12 2 the petitioner and learned Public Prosecutor were heard.
Considering the nature of the offences and possibility of the petitioner intimidating and inducing the witnesses, it is not in the interest of justice to grant bail at this state of investigation. Petition is dismissed. M.SASIDHARAN NAMBIAR, JUDGE. uj.
