Apprehending arrest, petition is filed under Section 438of Code of Criminal Procedure.

Learned counsel appearing for the petitionersubmitted that the only non bailable offence is under Section452 of IPC and it is due to the property dispute, the crimehas been lodged and the property belongs to the petitioner. Learned Public Prosecutor submitted that accused 2 and 3were already arrested and subsequently released on bail.

Considering the nature of the offences alleged, I donot find that custodial interrogation of the petitioner isnecessary. In such circumstances, petitioner is directed to ba 921/122surrender before the Investigating Officer within ten daysfrom today. Investigating Officer is permitted to interrogatethe petitioner. After completing interrogation, if arrested, petitioner shall be released on bail on executing a bond forRs.25,000/- with two solvent sureties each for the like sumto the satisfaction of the Investigating Officer on thefollowing conditions.i) Petitioner shall report before the Investigating Officer onthree consecutive saturdays between 10 and 12 am andthereafter as and when required. ii) Petitioner shall not induce, threaten or influence anyperson from disclosing facts known to him to the Investigating Officer or the court.iii)Petitioner shall not leave India without the previouspermission of the concerned Magistrate.M.SASIDHARAN NAMBIAR, JUDGElgk
