Narendran, J. JUDGMENT The Special Commissioner, Sabarimala has filed this report regarding the huge pendency in the counting of Kanikka in the Bhandaram of Sabarimala Sree Dharma Sastha Temple. A copy of Annexure 1 report dated 02.01.2024 of the Chief Vigilance and Security Officer, Travancore Devaswom Board is placed on record, along with the report.

2. In paragraphs 3 and 4 of the report, the Special Commissioner has stated that as per the report of the Vigilance Wing, large number of employees deputed for counting Bhandarams at Sabarimala were absent on 31.12.2023,

01.01.2024 and 02.01.2024, which has contributed for the huge pendency in the counting of coins and currency notes in the Bhandaram.

3. On 05.01.2024, when this report came up for consideration, the learned Senior Government Pleader and also the learned Standing Counsel for the Travancore Devaswom Board sought time to get instructions on the suggestions made by the Special Commissioner, Sabarimala. By the order dated

05.01.2024, the 3rd respondent Devaswom Commissioner was directed to take necessary steps to ensure that the staff in the SSCR No.1 of 2024 4 Establishment Wing and Class IV employees deployed on special duty are reporting for duty in time. Paragraph 8 of that order reads thus: “8. The 3rd respondent Devaswom Commissioner shall take necessary steps to ensure that the staff in the Establishment Wing and Class IV employees deployed on special duty are reporting for duty in time. Any failure on their part shall be dealt with appropriately in terms of the directions contained in the order of this Court in the decision referred to supra. In case there is huge pendency in counting of coins and currency notes of Kanikka in the Bhandarams at Sabarimala Sannidhanam as pointed out the report filed by the Special Commissioner, Sabarimala, the 3rd respondent Devaswom Commissioner shall deploy additional staff the Establishment Wing/Class IV employees on special duty at Bhandaram, without any further delay.”

Today when this matter is taken up for consideration, the learned Standing Counsel for Travancore Devaswom Board has made available for the perusal of this Court a communication dated 06.01.2024 issued by the Secretary of the Board to the 3rd respondent Devaswom Commissioner, regarding the decision taken by the Board on the suggestions made by the Special Commissioner, Sabarimala. The relevant extract of communication read thus: “നിലവിൽ ബഹുഭൂരിപ്ᩌം ജീവന്കാരരയും ശബരിമല SSCR No.1 of 2024 5 ഡ്യൂ്ᨾിᩄ᪚്ക് നിരയാഗി്ചി്ᨾു്ളതിനാൽ ര്ᩌത്ത്ങളുടെ ദൈനംൈിന ത്പവർ്ᩈന്ങടള ബാധി്കും ശബരിമല ഡ്യൂ്ᨾിᩄ᪚്ക് വിധം ര്ᩌത്ത്ങളിൽ ജീവന്കാർ ഇലലാ്ᩈ ്ഽിതി വിരശഷമാണു്ളത്. ശബരിമല സ്ടപഷയൽ ക്മിഷണറുടെ നിർരേശം പരിഗണി്ച് ചുവടെ വിവരി്കും ത്പകാരം നെപെി സ്വീകരി്കു്നതിനായി താ്ഝടള ചുമതലടെെു്ᩈി ഉ്ᩈരവായ വിവരം അറിയി്കു്നു.

1. എലലാ ത്ഗൂെിൽ നി്നും ശബരിമല ഡ്യൂ്ᨾിᩄ᪚്ക് നിരയാഗി്കാൻ സ്ാധി്കു്ന 2 ജീവന്കാരുടെ വിവരം അതത് ത്ഗൂെ് അ്സി്ഹൻ്് രൈവസ്വം ക്മിഷണർമാരിൽ നി്നും വരു്ᩈി ആയവടര നയൂ്ᨾിᩄ᪚്ക് നിരയാഗി്കു്നതിനും ഇത്പകാരം ജീവന്കാടര നിരയാഗി്കാൻ ഇലലാ്ᩈ ത്പസ്തുത വിവരവും റിരൊർ്ᨾ് ടച്യു്നതിനും തുെർനെപെി പ്ᩌം സ്വീകരി്കു്നതിനായി താ്ഝടള ചുമതലടെെു്ᩈു്നു.

2. പഴയ ഭ്ണാര്ᩈിൽ നി്നും പുതിയ ഭ്ണാര്ᩈിരലᩄ᪚്ക് നാണയ്ങൾ മാ്റു്നതിന് ര്ᩌത്ത ജീവന്കാരുടെ ഡ്യൂ്ᨾിയിൽ മാററം വരു്ᩈു്നതിരനാ, അധിക ഡ്യൂ്ᨾി നൽകു്നതിരനാ ശബരിമല എക്സ്ികയൂ്ᨾിവ് ആഫീസ്ർ്കും, ആയതിരലᩄ᪚്ക് രവ്ി ശുപാർശ സ്മർെി്കു്നതിന് ഭ്ണാരം സ്ടപഷയൽ ആഫീസ്ർ്കും നിർരേശം നൽകു്നതിനായി താ്ഝടള ചുമതലടെെു്ᩈു്നു.

3. ഭ്ണാരം ഡ്യൂ്ᨾിᩄ᪚്ക് നിരയാഗി്ച് അനധികൃതമായി അവധിടയെു്ᩈ ജീവന്കാർ്ക് െിയാ്മാർ്ക് കാരണം കാണി്കൽ രനാ്ᨾീസ് നൽകു്നതിനും. രനാ്ᨾീസ്ിന് തൃപ്തികരമായ മറുപെി ടതളിവുകൾ സ്ഹിതം രബാധിെി്കാ്ᩈവർട്കതിടര അ്ചെ്ക നെപെി ദകട്കാ്ളു്നതിന് രവ്ി തുെർനെപെി സ്വീകരി്കു്നതിനായി താ്ഝടള ചുമതലടെെു്ᩈു്നു.

4. ഭ്ണാരം ഡ്യൂ്ᨾിᩄ᪚്കു്ള ഷിഫ്ററുകളുടെ സ്മയത്കമം ഓരരാ മണി്കൂർ വീതം കൂ്ᨾു്നതിൻ്ടറ സ്ാധയത പരിരശാധി്ച് റിരൊർ്ᨾ് സ്മർെി്കു്നതിന് ശബരിമല എക്സ്സികയൂ്ᨾീവ് ആഫീസ്ർ്ക് നിർരേശം നൽകു്നതിനായി താ്ഝടള ചുമതലടെെു്ᩈു്നു.”

5. Heard learned Senior Government Pleader appearing for the 1st respondent and the additional 6th respondent, the learned Standing Counsel for the Travancore Devaswom Board for respondents 2 to 5 and the learned Amicus Curiae for the Special Commissioner, Sabarimala.

6. In Suo Motu v. Travancore Devaswom Board and SSCR No.1 of 2024 6 others [2022 (3) KLT 384], this Court issued specific directions regarding deployment of sufficient number of staff in the Establishment Wing of the Travancore Devaswom Board and Class-IV employees for special duty at Sabarimala Sannidhanam, Pamba and Nilakkal during the Mandala-Makaravilakku festival seasons and to proceed against the staff and employees who failed to report for special duty, other than on genuine medical grounds, by initiating disciplinary proceedings and the 3rd respondent Devaswom Commissioner has been directed to forward a list of such staff/employees and also the outcome of such proceedings to the Special Commissioner, Sabarimala, without any delay, so as to enable him to bring it to the notice of this Court by filing reports. Having considered the materials on record and also the decision taken by the Board on the suggestions made by the Special Commissioner, Sabarimala, as evidenced by communication dated 06.01.2024, this report is disposed of, making absolute the directions contained in the order of this Court dated 05.01.2024. The 3rd respondent Devaswom Commissioner shall take necessary action in terms of the communication dated 06.01.2024 of the Secretary of the Board, forthwith. The action taken by the 3rd respondent shall be SSCR No.1 of 2024 7 communicated to the Special Commissioner, Sabarimala, who shall file fresh report before this Court by 12.01.2024, if further directions from this Court are found necessary.
