1.1 ‘t 1 I Ti ti’ 1 I. 6 ORDER The petitioner In this writ petition is challenging the meeting notice

20.3.20 12 issued 5thi respondent/Chief Executive Officer, Taluk Panchayat. Bidar.

2. The grievance of the petitioner In this writ petition is that he was elected as a member of Taluk Panchayath from Bagdal constituency on 4.1.2011. Thereafter he was elected as Adhayksha for Taluk Panchayath on 14.2.2011. He has Just completed 12 months and 26 days as Adhyaksha of Taluk Panchayath. However, some of the members, who have politically against him, moved no confidence motion on

14.3.2012 for calling a meeting before the Executive Officer.

3. In pursuance to the requisition made by 1/3rd members, the Taluk Executive Officer, Bidar Taluk Panchayath, called a meeting for no confidence motion on

20.3.20 12 Issued by the 5’ respondent. the above writ petition has been filed. Lv 7

4. Sri J K Bukka, the Advocate for the petitioner contended that the earlier motion was moved for no confIdence on 2.3.2012. However, the said no confidence motion has been rejected by the Taluk Executive Officer. He also relied upon proviso to Sub-section 3 of SectIon 140 of Karnataka Panchayat Raj Act, 1993 (for short The Act’) and contended that no confidence motion can be moved within six months from the date of rejection of earlier motion. He also contended that the procedure followed by the Taluk Executive Officer is not in accordance with Section 14 1(2) of the Act. Hence, he prayed for quashing of the Impugned meeting notice by allowing the writ petition.

On the other hand, Sri Manvendra Reddy, Government Advocate appearing for the State Government argued in support of the meeting notice dated 20.3.20 12 contending that the majority of members have expressed their no confidence against Adhyaksha and the 1/3” members have given a requisition for calling a meeting.
