On 23.12.2001, the complainant (P.W. 1) came along with four persons in Maruti Omni Car to the house of the accused at Padageri with an intention of taking away ctpboard. The same was objected to by the accused. Scuffle took place between the complainant and the accused. At that point of time, accused No.1 allegedly assaulted the complainant with the sickle. P.Ws.2 to 5, who accompanied the complainant in the car came to the rescue of the complainant, they were also assaulted by the accused on various parts of the body with chopper and sicides. Consequent upon such assault, P.Ws.
1, 3, 4 and 5 suffered grievous injuries and P.W.2 suffered simple injuries. Immediately they were admitted to the hospital and thereafter to a private hospital at Hubli. As aforementioned, the complaint was lodged by P.W. I at 07:00 p.m. on the very day, that is, 23.12.2001. The Police after investigation, laid the charge sheet against the accused for the offences punishable under Sections 6: 307, 32.6, 427, 506 read with Section 34 of the Indian Penal Code. In. or.der to prove its case, the prosecution in all examined 14 witnesses, got marked 26 exhibits and 15 material objects. 3.
The trial Court on evaluation of the material on record and on hearing, convicted all the accused for the offences punishable under Sections 307 and 427 read with Section 34 of the Indian Penal Code and sentenced them to undergo rigorous imprisonment for a period of 3 years and to pay fine of Rs.4,000/ each with default clause,

9. The evidence of P.W. 1 fully corroborates the version found in Ex. P-i, the complaint. Before the Court he has deposed that he went to the spot along with P.Ws 2 to 5 in a Car at about 3.15 p.m. on 23-12-2001 and went inside the house. When he was talking with his mother, in the matter of taking away the cupboard, the three accused came from inside the house and threatened P.W. 1 with dire consequences. Accused No.1 assaulted the complainant with sickle on his head and on the right hand consequent upon which P.W. I sustained bleeding injures. When P.Ws 2 te 5 tried to intervene they were also assaulted by the accused. He has also deposed about the damage caustd to the Car by the accused. He has further deposed that P.Ws 1 to 5 fled away from the scene in the damaged Car itself up-to Gidamavinakatte and thereafter they went in a different Car to the Government Hospital at Sirsi for treanient. Having regard to these facts and circumstances we are dearly of the opinion that the intention of the accused was not to commit murder of any of the injured including P.W. 1 but only to protect their property by prohibiting P.W. 1 and his friends from entering the house. During the said process the scuffle has taken place.
18. The defence version is that P.W. I came along with four gundas (P.Ws 2 to 5) to the house of the accused on the relevant date armed with weapons with a view of assault the accused and their mother. However, in order to protect themselves they opposed P.W. 1 and his friends coming inside the house and therefore the scuffle took place and in the said scuffle the injuries are sustained by both the groups.

In view of the above, in our considered view that the Trial Court may not be justified in convicting the accused for offence under Section 307 of IPC. 20: However, the accused are liable to be convicted under Section 326 of the IPC inasmuch as they have caused grievous injuries to P.Ws 1, 3, 4 & 5 with dangerous weapons. Since they have also damaged the car belonging to P.W. 1 without any reason, the Trial Court is justified in convicting the accused for offence under Section 427 of IPC also.
20. We have heard Sri Somapur, the learned counsel appearing for the accused, on the question of sentence. He submits that all the brothers appear to have settled their disputes amicably; since the incident is of 2001 the brothers have forgotten their differences during the period of about 10 years; that the accused have already suffered imprisonment for about 14 days and that itself would be the sufficient punishment under the facts and circumstances. However, the said submission is opposed by Sri V.M.Banakar, the learned Additional State Public Prosecutor. 21 Since th incident has occurred on a trivial matic r relating to cupboard and as the parti s in oh.ed ire t rothers inter se and there is no int’ ntion on the part of the accused to commit harm to thc injured, in our considered opinion, the interest of justice will be accused are sentenced to undergo imprisonment for a period of three months and to pa a fine of Rs 10,000 Accordingly the following order is made a) The Judgment and order of conviction, convicting the accused for the offences punishable under Sections 307 of IPC is . un ted, btdrids modified Insic id tue accused re on t d for tl t pun shabh idititi rt ‘C t r Tb Judgire t n o t e I o I ,I t ‘C I c f d PC months for the offence under Section 307 read with 34 IPC. We have consciousi not imposed default sentence with a view to compensate the injured for the injuries sustained and damage to the car, The fine amount shaH be recovered as per law if not deposited by the accused voluntarily.
