Having taken note of the submission made by the learned counsel appearing for the parties, the distance between Gadag and Nippani is nearly 250 kilometers and also petitioner herein has filed Crl. Misc. No.246/2023 (Annexure-B) under Section 125 of Cr.P.C. seeking maintenance. In that view of the matter, I find force in the submission made by the learned counsel appearing for the petitioner that more hardship will be caused to the petitioner herein and therefore the petition is allowed. M.C.No.56/2024 pending consideration before the Senior Civil Judge and JMFC, Nippani is hereby withdrawn - 3 - NC: 2025:KHC-D:4103 CP No. 100232 of 2024 and transferred to the competent Family Court at Gadag forthwith.
