5. However, from the material on record, more particularly the evidence of P.Ws.5, 11 and 12, we find that there is a prima facie case under Section 306 of the Indian Penal Code. But charge is not framed for the offence under Section 306 of IPC. The charge is under Section 498(A) of the Indian Penal Code. The trial Court has not taken pains to see as to whether the case falls at least under Section 306 of the Indian Penal Code or not.
