23.2.2011. At the time of disposal of the appeal. pendencv of this cross objection was not brought to the notice of this Court. This is how the cross objections came up before us for final disposal.

Learned counsel for the cross objector filed a memo specifying the survey number involved, the extent of land involved and the nature of crops grown on the lands. It is stated that in Sy.No.85/1A and 85/3A Pomegranate is grown. In respect of Pomegranate plantation, this Court determined the market value at 5,75,000/- per acre before the Lok Adalath and the same is not disputed by learned Government Advocate. So also it is stated that in respect of Sv.No.85/ 1 A to an :3: extent of 01 acre Ber (Bare) (80 trees) plantation is situated. Even in respect of lands where Ber is grown the market value is fixed at 5,04,000/ - per acre. In respect of Malberry (Sericulture) plantation, a sum of Z6,90,000/- per acre is determined as market value.

In the circumstances, the Cross-objections are hereby allowed with costs. Determining the market in respect of Pomegranate grown area at Z4,75,000/- acre, Ber (Bare) plantation 5,04,000/- per acre (for 80 trees at the rate of6,300/- per tree) and Mulberry plantation at Z6,90,000/- per acre.
