10. PW 29 is the doctor who conducted the post mortem examination over the dead body of the deceased. His ft port is at Ex P.39 The same ats eveale that bum njurie arc oindo t .rp t n d iN cdd t i ntnath 0th ,p n i e”jt of br Hn th a I ‘1, the death is homicidal in nature and that the prosecution has made out its case against accused No.1. As aforementioned the material against accused Nos.2 and 3 as well as accused No.4 is shaky and such material does not prove the case against them beyond reasonable doubt.
11. The trial court is also justified in convicting accused No.1 for the offence punishable u/s 304-Cl) IPC. The injuries were not on the vital portions of the body. All the injuries were found on the lower half portion of the body. The victim was living for a period of three months after the incident in question. Under these circumstances, the trial court justified in concluding that the offence committed by accused No.1 falls u/s 304-(I) of IPC and not u/s 302 of IPC. The reason assigned by the court below for awarding 5 imprisonment for the offence punishable u/s 304-(I) and one imprisonment u/s 498-A IPC is just and proper. Accordingly, we pass the following order: I) The judgment and order of acquittal acquitting accused No.4 namely Shankrappa - 23 - s/c Laxman Nagavvagol passed by the trial court stands confirmed, ii) The judgment and order of acquittal acquitting accused Nos.1, 2 and 3 for the offence punishable u/s 302 of IPC stands confirmed, iii) The judgment and order of conviction convicting accused No.1 for the offence punishable u/s 304-(I) IPC and section 498- A of IPC stands confirmed, iv) The sentence imposed by the court below for the said offence also stands confirmed, v) The judgment and order of conviction convictbig accused Nos.2 and 3 namely Mallappa s/o Muttawwa Nagavvagol and Adiveppa s/o Laxman Nagavvagol convicting them for the offences punishable u/s 304 (I) r/w 34 IPC and 498-A IPC stands set aside. Accused No.2 and 3 are acquitted of all the charges.

In view of the above, we make it further clear that accused No.1 Muttawwa d/o Laxman Nagavvagol undergo imprisonment five years the offence punishable u/s 304 (I) IPC and one year for the offence F. -24- punishable u/s 498-A IPC as directed by the court below. The sentences shall run concurrently. Accused Nos.2, 3 and 4 are acquitted of all the charges.
13. We place on record the valuable assistance rendered by Sri.H.R.Hooli appointed as Amicus Curiae. We direct that an amount of Rs.3,000/- shall be paid to him as honorarium. Accordingly, Crl.A.
