JUSTICE S.R.KRISHNA KUMAR - 4 - NC: 2026:KHC:6633 WP No. 39356 of 2025 HC-KAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “i) Issue a writ of certiorari or any other appropriate writ directing the Ld. XIX Additional City Civil and Sessions Judge, Bengaluru (CCH-18) (“Ld.Trial Court”) to consider I.A.No.4 filed by the petitioner under Order VII Rule 11(a) and (d) of the Code of Civil Procedure, 1908, in O.S.No.6771/2024 within such reasonable time as this Hon’ble Court deems fit; Annexure “C” file on 16.01.2025. ii) Grant such other relief as this Hon’ble Court deems fit in the facts and circumstances of the above case, in the interest of justice and equity.”;
2. Heard learned counsel for the petitioner and perused the material on record. For the order proposed, notice to the respondents is dispensed with.
3. After arguing the matter for sometime, learned counsel for the petitioner submits that the petitioner, who is the defendant No.5 in the suit before the trial Court has filed an application I.A. No. 4 * directed disposed of as expeditiously as possible.

5. Accordingly, the trial Court before whom the petitioner- defendant No.5 an application for * O.S.No.6771/2024 is directed to dispose of the said application within a period of 1 month from the next date of hearing i.e.,
18.03.2026.
