The issue is a case and a counter case. The offences against each other are the one punishable under Sections 354B, 323, 324, 504, 506 read with Section 34, 143, 147, 149 of the IPC and inter alia. 3. During the pendency of the subject petition, the parties to the lis, both in the case and counter case, have entered into a settlement and by drawing up certain terms of compromise. 4. The terms of compromise as drawn by the petitioners and the respondents read as follows : “The petitioners and respondent No.2 in the above noted petitions most humbly state as under:- - 7 - NC: 2025:KHC:4452 CRL.P No. 10569 of 2024 C/W CRL.P No. 6740 of 2024 CRL.P No. 14114 of 2024 CRL.P.NO.356 of 2025 1. The petitioners in Crl.P.No.356/2025, Cr.P.No.10569/2024 and Crl.P.No.6740/2024 are the accused No.1, 3, 4, 5, 6 and 7 in C.C.No.59/2023, pending on the file of learned Civil Judge and JMFC, Gudibande for the offence punishable under Section 354(B), 323, 324 504, 506, 143, 147 and 149 of IPC. The petitioners in Crl.P.No.14114/2024 are the accused No.1 and 4 in CC. No.72/2023 pending on the file of learned Civil Judge and JMFC, Gudibande for the offence punishable under Section 354B, 323, 504, 506, 34 of IPC. The above said petitions have been filed seeking quashment of proceedings registered against them in CC.No.59/2023 and CC.No.72/2023 pending on the file of learned Civil Judge and JMFC, Gudibande arising out of Crime No.220/2022 and Crime No.221/2022, registered by the respondent No.1/Peresandra Police. The same Investigating Officer filed final report in both the cases. 2. There is a Civil dispute between the parties and the criminal cases filed by the respective de-facto complainant is the off shoot of the civil proceedings. In order to have continuous cordial relationship between the parties, the parties have filed this petition for compounding the offences. 3. The respondent No.2 in Crl.P.No.356/2025. Crl.P.No.10569/2024 and Crl.P.No.6740/2024 filed complaint before the respondent No.1/Police, which came to be registered in Crime No.221/2022 against the petitioners. The respondent No.2 in Crl.P.No.14114/2024 - 8 - NC: 2025:KHC:4452 CRL.P No. 10569 of 2024 C/W CRL.P No. 6740 of 2024 CRL.P No. 14114 of 2024 CRL.P.NO.356 of 2025 filed complaint before the respondent No.1/Police, which came to be registered in Crime No.220/2022. 4. The petitioners and respondent No.2 in the above said cases are the neighbors and by the intervention of the elders, friends and well-wishers, they agreed to settle the dispute and live peacefully. There is no force, coercion, threat for entering in to this compromise. The compromise is voluntary one and that the compromise is legally valid. 5. The respondent No.2 in Crl.P.No.356/2025, Crl.P.No.10569/2024 and Crl.P.No.6740/2024 and respondent No.2 in Crl.P.No.14114/2024 have no objection to quash the proceedings registered against the each other and against other petitioners. Wherefore, the petitioners and respondent No.2 in Crl.P.No.356/2025, Crl.P.No.10569/2024 Crl.P.No.6740/ 2024 and Crl.P.No.14114/2024 humbly pray that this Hon'ble Court may kindly be pleased to permit them to compound the offences and further be please to quash the proceedings in CC.No.59/2023, pending on the file of learned Civil Judge and JMFC, Gudibande for the offence punishable under Section 354(B), 323, 324, 504, 506, 143, 147 and 149 of IPC and CC.No.72/2023 pending on the file of learned Civil Judge and JMFC, Gudibande for the offence punishable under Section 354(B), 323, 324, 504, 506, 34 of IPC, in the interest of justice. - 9 - NC: 2025:KHC:4452 CRL.P No. 10569 of 2024 C/W CRL.P No. 6740 of 2024 CRL.P No. 14114 of 2024 CRL.P.NO.356 of 2025 5.
