JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners - wife, husband and their family members, are before this Court calling in question registration of a crime in Crime No.93/2022, pending before the C/C Additional Civil Judge and JMFC, Hosadurga, for the offences punishable under Sections 143, 147, 498A, 323, 504, 506, 354B r/w. 149 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961, in both petitions.

#2. Learned counsel for the petitioners and respondent No.2 in unison submit that during the pendency of the petitions, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking quashment of the proceedings by permitting them to compound the offences. - 5 - NC: 2026:KHC:8544 CRL.P No. 15135 of 2025 C/W CRL.P No. 9156 of 2022 HC-KAR They submit that the couple have obtained a decree of dissolution of marriage and parted their ways. The parties have filed joint memos in both the petitions before this Court.

#3. The joint memo filed in Crl.P.No.15135/2025, reads as follows: “2. The Petitioner No.1 and Respondent No.2 in the above matter submits that, the marriage of The Petitioner No.1 and Respondent No.2 MC.No.59/2024 on the file of Senior civil Judge and JMFC, Hosadurga in pursuant to settlement between them and accordingly, the parties to the proceedings have sorted out their difference by way of settlement, accordingly the marriage of the Petitioner No.1 and Respondent No.2 dissolved through a decree of dissolution of marriage through mutual consent petition. dissolved

#3. In view of the settlement the Petitioners has agreed to pay sum of Rs.4,00,000/-(Rupees Four Lakhs) as permanent alimony to Respondent No.2. That out of the said total sum, the Petitioner No. 1 has already paid a sum of Rs.2,00,000/-(Rupees Two Lakhs) through Demand Draft dated 06-09-2024 bearing no.379015 drawn in Canara Bank, KB Cross, which was handed over to Respondent No.2 during the settlement of matter in MC No. 59/2024 and same has been acknowledged by the Respondent No.2. The remaining amount of Rs.2,00,000/- (Rupees Two Lakhs) is agreed to handover during the settlement of above matter. Accordingly the Petitioner No.1 is handing over a Demand Draft for Rs.2,00,000/- (Rupees Two Lakhs) drawn on date 26/11/2025 bearing no.379188 drawn in Canara Bank, K B Cross. It is except the above matter and Crl. Petition No.9156/2022, all other matters between the Petitioners and Respondent No. 2 settled. In view of the settlement the Respondent No.2 has no objections to quash the FIR questioned in the above matter against the Petitioners and Petitioners in Crl. Petition No 9156/2022 (All the Accused of Crime No.93/2022) filed for the offences under Section 143, - 6 - NC: 2026:KHC:8544 CRL.P No. 15135 of 2025 C/W CRL.P No. 9156 of 2022 HC-KAR 147, 498A, 323, 504, 506, 354B read with Section 149 of Indian Penal Code, 1860 and Section 3 and 4 of Dowry Prohibition Act, 1961.” The joint memo filed in Crl.P.No.9156/2022, reads as follows: “Wherefore, the Petitioners and Respondent No.2 to prays that this Hon'ble Court be pleased to quash the FIR in Crime No.93/2022 for the offences under Section 143, 147, 498A, 323, 504, 506, 354B Read With Section 149 of Indian Penal Code. 1860 and Section 3 and 4 of Dowry Prohibition Act, 1961 on the file of Additional Civil Judge and JMFC Hosadurga and all further proceedings in pursuant to said FIR in terms of settlement in the interest of justice and equity.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the application and terminate the proceedings against the petitioners in both the petitions, as the allegations are not against the State.

#4. For the aforesaid reasons, I pass the following: (i) The criminal petitions are disposed.
